'Disproportionate' might be a better term to use than 'unjust'

What they could do could be to submit that since he was subjected to cruelty while incarcerated in that particular facility in (presumably) Gurgaon, they could move to have him incarcerated in a different facility, maybe in a separate city in Haryana outside Rana's jurisdiction. That would be something that the lawyers would have a good chance of getting, but that's not something acceptable to Viraj. He wants to roam about scot free, which is problematic given his own criminal record.

I haven't watched the episodes (watched LifeOK's YT version of Thursday's episode), but it seems to me that when Raghav found out that Viraj got back his memory and once Rana was removed from his post, Raghav had no qualms about turning him back in to the law. Given that Viraj had resumed stalking Sia, that was actually justified

Just looking at the law side of things.. Viraj shud be eligible to get his sentence reduced - bec of the unethical shock treatment that happened when he was serving his sentence.
Bec if something like this happens - law has to compensate - don't they? Just a general question.

If certain rogue elements in law enforcement abuse the law and don't implement it properly, does the law owe the prisoner anything? I think the law owes it to society to punish those who abuse their power and the law, but that's a completely separate transaction from the dealings b/w the prisoner and the law, since the prisoner's account w/ society is not yet resolved.

But for this serial, given how they've been showing the police as corrupt from day 1, this issue would have to take a back seat to all the occasions that Viraj bribed the police to do his bidding, and pretty much had Unniyal at his beck & call. Yeah, Unniyal too got jail (I'm assuming he's safe there from Viraj 😆) but everyone who took bribes from Viraj ought to be suspended for not being available for Jhanvi to go to. Abused women should be able to freely approach the police, and not have to change identities or flee to ashrams.

Sorry, didn't mean to stray from the main subject, which is Viraj contesting this case. But I think this particular abuse dwarfs in comparison to what the police did earlier. The only time they were shown in good light at all was b/w Viraj's arrest, and the hostage situation.

In that case, why do people get consideration for revealing information or cooperating? I don't mean before the initial sentencing and taking pleas given. I mean having one's sentence reduced in exchange for information or testimony while he was already in the process of serving the sentence.

Sure. The prisoner is helping the law and perhaps society for such cooperation. Still, should they?

This actually brings me to another aspect which I did have in the back of my mind, but was too lazy to bring up. Viraj would essentially be a criminal informant regarding Rana from here on (well aside from the fact that he might break out of jail and do it as Raghav did when Viraj framed Raghav for Sunder's attack).

Another point is that Viraj was showed a type of cooperation with Raghav to trap Rana and save Krish. The only issue of course is that Raghav is not the law, and Raghav had to serve some time for keeping Viraj away from the cops. But Raghav was let off for faking evidence and all during the fake marriage track. So, why not this time? He was up against a corrupt system.

But all of Viraj's actions should have gotten him some kind of consideration.

The other aspect is that they never bothered with it because they believed Viraj was not in his right mind. It might have been easier to keep mentally retarded Viraj institutionalized deal than deal with the hassle of freeing him . (Horrible, yes!) Which is why as I said before, Raghav was essentially right in concluding that Viraj shouldn't be back in the institution and even that Raghav would take responsibility (leaving aside how nuts it was to bring Viraj back to the people,, family and woman he tormented).

(Adding on, yes I know Raghav's main worry was that Viraj was in danger, not that Viraj shouldn't be back in the place he was tortured.)
