I think the pre-nup has the words that if Om fails to marry Swetlana his property will go to his would be wife instead of (would be wife Swetlana.) This is the loophole. At that time Swetlana had overconfidence on Omkara that he will definitely marry her for the sake of Jaanvi.
From the beginning he didn't like to marry her and he was thinking continually how to throw her from the house. He reminded his brother Shivaay's words before signed that document . Now he used the chance perfectly. So he did not tell lie to Swetlana.

Like Pride comes before a fall greed comes before a fall too! Svetlana got too greedy. She also got over confident. She thought she would either marry Omkara and get his everything or even if he doesn't marry her she will get everything. If she had tried to get some money instead of getting too greedy then she would probably have made some money from this. But she got over confident.

I think Svet must have got even more excited when Tej gave his shares to Om and Jhanvi. She must have thought, more money for me. LOL

Prenup was very clear loophole and was fabtastically used to start Rikara story I Just loved it

Best n interesting track after long n it's worth watching

Waise just FYI prenuptial agreements have no legal validity in India

Yes any layman would have done that, but Swetlana was super intelligent so she complicated the stuffs

Even I was wondering the same, it totally didn't make sense. But thinking about it, maybe what they were trying to say were two points.

1. After marriage all of Omkara's property goes to his wife (where Svetlana failed to mention her name, as it was a prenup about Omkara's and her wedding)

2. If Omkara fails to marry Svetlana, all of his wealth would go to Svetlana.

So, now we look it from legal point of view, Omkara is already married (at the time of signing the prenup), so all of his wealth is no longer his, it now belongs to his wife, Gauri (according to Svetlana's prenup.)

So right now, Omkara is a man with no property or money. Now that he has failed to marry Svetlana, all his money and property will go to Svetlana but due to her own prenup, Omkara is a penniless man. Which ends up with her not getting anything, and Gauri getting everything including the man, and Omkara not in any legal mess.

yeah that prenup is invalid and actually Svetlana can use the prenup to file a case against Omkara for fraud, as he being married cheated her by promising marriage (and she cud even say he took advantage of her)

In my limited understanding, Rikara marriage actually is another thing...
If it is taken to court, then Omkara and Gauri willfully got married in presence of witness, so if they want they can claim it is legal and register their marriage or say that marriage is not valid as it was a drama done to save her life from an angry mob. It would actually depend on a good lawyer and what Omkara and Gauri claim.
