My way of looking at this(and before anyone starts quoting, please read the entire content and then comment) , Wasnt arguing just for the sake of it, I had a concept in mind😉. Only when you are convinced can you make an approach😆, or else you come up with broad sweeping statement😉
In my scenario
BCCI has no control over who and how many commercials any players do, the only rule is the preceeding 15 day before a event, there should not be any time spent on commercials, so players are fresh before the cricket event(like training camp or a match)
How does an endorsement work? A player has good track record he is performing well the company is cashing in on his image to market their product, so they are tying the fortune of their product to the player. In the case of WC 2007 there were crores of rupees of losses incurred by companies b'cos they did not get to broadcast their commercials
After WC 2007 debacle, Some players (in good fatih or fearing backlash) told the companies to hold the endorsement, naturally the company will have a clause in place where the player's remuneration is reduced for that
So hopefully the companies have learnt the lesson, now when they contract a player it will be for a year or a season(now a year/season will mean the player will have to perform in that year to get an endorsement next year). Player plays well, he gets endorsements, he does not or get dropped from the team he loses the endorsement for the next year
How does an endorsement time actually work?
now how much time does an endorsement take to shoot, 45 sec spot, say 3-4 versions, maybe a week?
If a player has 8 endorsements, that is 8 weeks in a year, the cricket season spans 30-35 weeks in a year. He still has 15 more weeks of spare time.There is enough time to recuperate, isnt it?
How the BCCI has messed this up
Now BCCI says only 3 endorsements/player. Now say a player has played well for a season, he goes to a company and says well I can only do 3 endorsements, so my rates are higher now(company loses right there) and I want a guaranteed contract for 5 years(normal contracts for Sachin/Sourav/Dravid) are 4-5 years. The company is tied up into a player for no reason for more time due to this stupid decision by BCCI, the only out clause guaranteed by the constitution is social behaviou, say a player is caught having drugs or in a rape charge or similar offense then the company can terminate the conract.
Also now in bargain the company get to ask for more prominent times when they can air their commercials, so those drinks breaks will be larger, so player coming out to bat commercials will be longer, that is how it works in the NBA, NFL and MLB. a hr long football game lasts 4 hrs, a basketball game lasts ( of 4 12 mins quarter goes on for 2-3 hrs) and Baseball game takes atleast 3 hrs
Cricket as it is a day-long event, it will just get worser
Well the player made the same money he has 5 more free weeks, maybe he can open up a restaurant in that time, he still has 15 more weeks of spare time.
More so, now employers can make a clause similar to this in their contractual terms, Stipulating what we can and cannot do in our personal life. If a employer thinks visiting a location like Goa is harmful, it might as well be there and the supporting evidence can be BCCI's policy(That is a semi Govt body)
That clause in BCCI conract is populist measure but has no bearing on how the player plays or his purse gets affected.
In fact it hurts the consumer(that is us, where in we get to see a player doing commercial even if he is dropped) and the company.
And my approach doesnt make end-runs around (the inconvienient)democracy 😉
How the clause came about, There is a team of 7 captains who came up with recommendations and this was always on their list, if you count the number of commercials they did you will know, it is a situation of we couldnt do it in our times, why should these new kids do it, Pretty typical 😉
