Direct discrimination occurs
when a person "treats another
less favourably than he treats or
would treat "another person (a
women or a person from a
different racial group).
Discrimination claim is based
upon the comparator principle.
So it will be pivoted around the
hypothetical fellow employee
who is in same position as the
applicant, but who is of a
different gender or race etc. This
means that a person will have to
prove that they have been
harassed in breach of the
statutory legislation and prove
that it is a direct result of their
sex, age disability etc. Applicants
will have to establish that they
belong to one of these
categories and if claiming direct
discrimination, that they were
discriminated because they fell
into that category.

It could be about evidence gathering to proove a case of direct discrimination. I wonder what sort of evidence that would call for.
Couldnt the gender /religion/race be incidental to the employee's poor performance?

It could be but no harm in trying to cry Disriminatory role to save ones skin 😆 Adds to the lawyer's kitty.

There are more discrimination between the members of the trade unions. Together they all fight for the same rights/privileges...but then we want ourselves to earn a little higher than the person next. 😛

who is racial? the boss? go to your boss's boss.. companies usually have policies against racism..yet people are full of racism inside..
most men always think of women as objects even if they are 100 times smarter than them..but then there are some good guys too
providing evidence for these things is nearly impossible .. no one would be obvious racist.. i usually prefer talking to people directly when i have a problem
