I think the VO imples more to the fact that Ellis had a right to take Mer coz Mer was her own dotty but Mer had no right what so ever tot ake Zola coz Zola till now wasn't theirs in spirit sure she was theirs since the very first moment Der took her in his arms but in name she wasnt...hence even though Zola in spirit is Mer's daughter she had no right to take her and hence it is almost like kidnapping at least for the social worker and adoption agency
