Animal rights activist Maneka Gandhi comes out strongly against Salman Khan's five-year sentencing in the Chinkara poaching case

"It is an excellent judgement. The man should have gone behind bars long back. I am sure he will try and get out of the jail somehow. Look at the arrogance of the man; he didn't even bother appearing in court! He seems to have taken the whole issue so lightly. Suddenly now he will fall sick or quote heart problems to get out of this.

Hundreds of poor people are behind bars because of the wildlife protection laws, but people like Salman, (Mansur Ali) Pataudi and now this new sports person Manavjit Singh Sandhu go scot-free. They think they are above the law. I think this judgement is a shining example of how nobody can escape the law.

The film industry has been against me for speaking the truth. They say so many films depend on Salman, so he shouldn't be jailed. If that is the case, shouldn't that apply to a doctor too? He can also get up and say my patients are dying, so please don't put me behind bars. Salman is not doing anybody a favour by doing films; he is earning money for himself. He should have got 14 years imprisonment in all!

'He will be granted justice eventually'

Subhash Ghai defends the star...

"Salman Khan is one of the finest human beings I have met in the industry. I say this because I got to know him closely in the past two years. We all know that he is paying the price of being a celebrity. But we are also sure that he will be granted justice by the law and courts eventually. As per Salman's lawyer Dipesh Mehta, he was not directed by the court to be physically present yesterday on the day of the judgement. Though he missed his flight yesterday he will appear in court again on Tuesday to seek justice. We all pray for Salman."

Mumbai Mirror Bureau

Salman Khan with his lawyer at his Bandra residence on Friday

After Sanjay Dutt, it is Salman Khan's turn to return to jail. On Friday, a Jodhpur court rejected the actor's appeal against his conviction in the 1998 chinkara poaching case.

Salman had appealed against a five-year jail term given to him by a lower court last year for poaching a chinkara, an endangered species under the Wildlife Act, near Jodhpur in 1998.

Khan did not appear in court on Friday and sent his sister Alvira instead who petitioned the court to defer the hearing. The court, however, rejected both the plea for postponement of the hearing as well as Salman's original appeal against his conviction. Khan is likely to surrender on Monday. He can, however, appeal against the conviction in the Rajasthan High Court. "Every citizen has the right to appeal so we will file a revision appeal in the high court as soon as possible," Khan's lawyer Dipesh Mehta said.

In a 76-page judgement, judge R V Singhvi said no court could ignore the circumstantial evidence against Salman.

"Circumstantial evidence is important in this case as it constitutes a chain that 'loudly says a crime was committed'," he said. Singhvi further said that convictions are based only on solid proof. If the chief judicial magistrate's court acquitted Salman for some crimes, that did not mean the star had not committed the crime of poaching a chinkara, he noted.

The court also allowed an appeal filed by one Gordhan Singh, who was convicted along with Salman and given a one-year prison term and a Rs 5,000 fine.

THE CRIME

Khan was convicted on April 10 last year for poaching two blackbucks at Ujiyala Bhakhar near Ghoda Farm on September 28, 1998 during the shooting of Sooraj Barjatiya's film 'Hum Saath Saath Hain'. He was sentenced to five years rigorous imprisonment and fined Rs 25,000. After his conviction by a lower court last year, Salman stayed in Jodhpur jail for four days.

OTHER CASES

• In another poaching case in Bhawad, Rajasthan, Salman has been sentenced to a one-year prison term. He has filed an appeal against that decision.

• Salman is also accused in the September 2002 Bandra hit-and-run case. He allegedly rammed his car into a bakery on September 28 that year killing one person and injuring four others. The trial is on at Bandra Metropolitan Magistrate's Court.
