Strong case against actor Saif Ali Khan, say police

MUMBAI: A day after he allegedly beat up a South African businessman at a five-star restaurant, actor Saif Ali Khan insisted he was attacked first and that the episode was not a publicity stunt for an upcoming film. At a press conference on the strategic alliance of his new film Agent Vinod with World Series Hockey, the actor said, "I have already said there are two sides to the story. I have complete faith in the court of law and they will best decide about the case."

Police sources said there was a "strong case" against the actor and his friends, businessman Shakeel Ladak and producer Bilal Amrohi. The three were arrested on Wednesday for assaulting businessman Iqbal Sharma and his father-in-law Raman Patel. They were granted bail at Colaba police station within an hour.

"We have questioned eyewitnesses, including the hotel staff and management. Their statements have corroborated Sharma's version. This is a simple case so far and we will file a chargesheet very soon," said a senior officer involved in the probe.

Saif had filed an application through his lawyer on Wednesday, levelling charges against Sharma. The actor alleged that Sharma and his father-in-law came to his table and started abusing the ladies with him, and started the fight. The application said he was later approached by Sharma's mother-in-law who requested him to forget the matter, saying no one was in their right mind. "We have registered a non-cognizable offence in this matter. However, currently there is no strong evidence in his case. If he gets medical documents to prove he was hurt and assaulted, we will register an FIR," the cop said.

The officer added there was no CCTV footage available as the five-star restaurant had not installed cameras in order to respect the privacy of their guests. "We have no recorded footage of the incident. We have interrogated the hotel staff and taken down their statements. There were only these two parties present in the restaurant at that point so the management and staff are our sole witnesses," said the officer.

Denying the incident was a publicity stunt, Saif said, "I never publicize my film in a negative manner. Whoever does that, it depends on the mentality of the production house and their class."

While Saif is sticking to his stand, saying he has full faith in the law and has filed a complaint with the police alleging he was hit first, so is the complainant. Iqbal Sharma visited the Colaba police station on Thursday evening along with his wife to give a statement to the police. Sources said he left the station by 8pm. Terming Saif's allegation that he was attacked first as "rubbish", Sharma said, "Police have recorded my family's statement in the case." Reiterating that he couldn't say if Saif was under the influence of alcohol, Sharma said, "I can't really say, but the action of Saif that night was definitely not of a person in a sober state of mind." Sharma returns to South Africa on Thursday night but will be back soon.

Asked if he thought the cops have gone easy on the actor, Sharma said, "Not at all, the right thing was done according to the section under which the case was registered." He added police are definitely taking the case seriously and expressed satisfaction with its progress. Senior police inspector Vinod Sawant too denied charges of being lenient towards the actor and his friends. He said Khan had been treated like any ordinary citizen and the police had followed all protocol in his arrest. "We brought him to the police station in a police van, fingerprinted him and took down his statement. There is no question of partiality."

Speaking to TOI, filmmaker Anubhav Sinha said, "I personally know Saif, he is a thorough gentleman. It is inconceivable that he will violently react without serious provocation. It is unfair to run stories against celebrities just because it makes good TRP sense. Let the police do their job." Asked if stars misuse their position, filmmaker Ramesh Taurani said it was the other way and especially during outdoor shootings, stars get harassed by people who want to click photographs of them. "I have worked with Saif. I really don't know what transpired that night but I have never seen Saif losing his cool any time. He is a well-mannered and classy person," Taurani said.

Tajdar Amrohi, whose son Bilal was also arrested and later granted bail on Wednesday, told TOI, "It is an unfortunate incident. The NRIs wanted mileage and have managed to gain it by seeing themselves on national news. I am told the senior gentleman started the scuffle and Saif and his group only reacted. Besides they were also passing filthy comments against the women on Saif's table."

On the allegation that he was trying to gain mileage from the incident, Sharma said, "I don't need such mileage. They need it to be in the public eye."

But Bollywood, which usually voices its opinion on various issues on social networking platforms, chose to remain silent, barring a few like composer Vishal Dadlani. "Let me put it this way. If Saif was provoked or hit first, I think he did what many of us would do. By 'us', I mean myself and you guys. Not condoning or defending violence, but everyone's allowed to be human once in a while, no? I think every right-thinking person should ask this question," Dadlani posted on Twitter.

Mumbai: One of the employees of the Mumbai hotel where actor Saif Ali Khan allegedly punched an NRI businessman on Tuesday night has given a statement that goes against the claims made by the actor.

In his statement to the police, the employee has reportedly said that the actor provoked Iqbal Sharma and punched him first.

Saif was arrested late on Wednesday evening based on a complaint filed against him by Mr Sharma, who claims that the actor assaulted him and fractured his nose at Taj Hotel's Wasabi restaurant in Colaba. The actor was released on bail the same day.

In a counter complaint he filed hours after being released, Saif insisted that he acted in self-defence as he was attacked first. He claimed that Mr Sharma's father-in-law punched him first and that the duo abused the women who were accompanying him at the restaurant. He also alleged that his eye was swollen after he was hit. Sources in the Mumbai Police however told NDTV that the complaint filed by the actor does not stand as he has not backed his application with medical certificates.

Yesterday, the actor apologised for losing his cool and said,"...it is our responsibility that we always behave the right way. So in one way, I would like to apologise about what happened and I think even this could have been handled in a different way. I get angry at things any normal person will get angry at. But it should not be displayed in public."

The police say no video cameras were installed in the area where the brawl took place at Wasabi. They have so far recorded the statements of 15 people and prima facie, say sources, there is a "strong case" against the actor.

When the incident happened at Wasabi on Tuesday night, Mr Sharma, a businessman from South Africa, was seated at the table next to Saif and his group. The actor had other Bollywood friends with him - girlfriend Kareena Kapoor, Kareena's sister Karisma Kapoor, actor Amrita Arora, her husband, Shakeel Ladak, Amrita's sister Malaika Arora Khan, and Bilal Amrohi, a producer.

In his version of events, Mr Sharma says he sent a note to Saif's table, asking his group to talk a little softer. "They were making a lot of noise. And we asked the management to ask them to be quiet so that we could also enjoy our evening. This failed on about three occasions at least." Mr Sharma says his family and he decided to leave the restaurant; on their way out, they ran into Saif who had left Wasabi and was on his way back in. At this point, Mr Sharma says, Saif struck.

The actor has, however, denied this. Actor Salman Khan has stood up in his support. At an event in Mumbai today, he said, "I support Saif. My family was there (Malaika Arora Khan is Salman's sister- in-law) ...I know what happened."

Saif's home production, Agent Vinod, releases on March 23. It co-stars Kareena.

An open letter to Saif Ali Khan

Dear Nawab Sa'ab,
I would like to begin with a request. I write in peace. Please do not break my nose after reading this letter. I am aware such a request does not augur well for a correspondence, yet I insist you grant me this small wish before getting on with the rest of the letter. Unnatural. That's what I thought when I first heard about what had happened at the Taj Colaba with you the other night. I mean can you believe it? Is this for real? Nawab sa'ab, for a few minutes I felt I was transported to a different country, a country with a constitution, a real government with a real police force full of real anally retentive gems.

Frankly, sir, I don't care who started the fight or which one of you is right. It is not important in my opinion because a brawl is a very natural phenomenon. Agreed, fighting in a five-star hotel is typical Delhi behaviour but still it isn't unnatural, is it? Talking loudly at a table of 10 isn't unnatural either and getting annoyed dining near a loud table of 10 is often as normal as getting your nose punched.

You know what is abnormal Nawab sa'ab? The police actually filed an FIR. I can say this because though I am not famous like you, I don't exactly like to go out and have my cocktail dinner in a library, if you know what I mean, and very often I find myself in situations where instead of trying to figure out who asked whom to grow up and who behaved like an idiot and got what he deserved, the police simply beats up both parties.


Nawab Sa'ab, instead of dividing the people of the country into rich and poor, weak and strong, those that have grown up and those that have not, I think you may like to consider the world as essentially comprising two sets of people: those who can file an FIR and those who cannot.

In an ideal society, a man with a broken nose should rush to a hospital and the police should meet him there, or if the bleeding isn't so severe, the man should rush to the police station and get the cops to take him to the hospital, or a man with a broken nose should be rescued by the police and then taken to the hospital. In India, a man with a broken nose goes to the hospital and then goes home or, if the bleeding isn't so severe, goes home straight from the spot of the incident.

Did you file an FIR 18 years ago when the son of the then Delhi Police commissioner thrashed you in full public view for allegedly making a pass at his girlfriend in a nightclub? I was 13 years old. My mother was very upset. She was, and still is, a big fan of your mother and for a long time after you made your debut, she refused to believe you were not a girl. When I was 15, and loved you to bits in Main Khiladi Tu Anari, my friends thought I had a boy crush on you. Obviously, you and the Delhi police commissioner and his son were all equal before the law, why then did you not file a complaint? Perhaps, like Shirish Kunder and me, you too have immense faith in Roman Polanski and no one knows better than you that what happens in Chinatown stays in Chinatown. Today, I am 31 but unfortunately I don't think I have matured or grown up in your sense of the word. But I will grow up. I have hope in you. At 41, you are the bravest teenager I know.

You know what I think Nawab Sa'ab? I think this county is transforming itself into a no-country-for-ageing teenagers. I know what it feels like because I am an ageing teenager. Just think about it: Here you are, a brilliant chartered accountant or a businessman or a financial analyst with flashy teeth, basically a nobody, sitting with your boring wife and your stupid children having dinner at an expensive diner, tearing into the most expensive flesh money can buy wondering when you will financially evolve enough to be able to buy a decent conversation at a bar when a loud stream of consciousness, drunken perhaps, stabs the anxious joyless silence on your table, and, makes you aware for the first time that evening that at the helm of the next table occupied by as many as 10 people, sits your favourite celebrity.

What do you think will happen next, Nawab Sa'ab?
