See the main issue here is Maya's past. She has lied. She has manipulated. So she is a bad woman who can make accusation of rape.
When you look at rape cases specifically there are many things that are put against woman. One is called finger test. I dont know completely about this test, but this test ascertains whether the woman had sexual relation prior to rape. In the case of a married woman, or a woman having pre marital sex or a prostitute this goes against them. If you have watched Satyameva Jayate episode on rape you will see how much activists are protesting against this test as the defense lawyers claim the victim due to her sexual relations enjoyed rape. Having relation with your spouse, your boy friend or a customer is consensual, but that doesnt mean another man can rip apart a woman without her consent.
Second is the dress and the fact the victim provoked the rapist. This goes for acid attack also. Jilted lovers, use rape as a weapon to defame woman.
Conviction rate of rape cases is dismal at some 5-10%. The humilation a victim has to undergo during trials make many not go through it. Supreme Court has clearly told that a woman's past cannot be the reason, her way of life cannot be reason to deny justice to her. No man has right to touch the body of a woman without consent for whatsover reason.
In this case Ayan crossed all limits of decency when he tore apart her dress, mouthed flithy dialogues and bit her neck. If someone feels she crying bhabi was to manipulate where was his manners when he heard she telling him that. Saanjh talks about security in the apartment. It was not a stranger who attacked Maya. It is her brother in law. A man she is connected to.
Though I disagree with Arjun that a woman cannot fake rape charges, I dont feel Maya has faked rape attempt. There are many things go against her basic character if she has staged it. Maya has fear of touch. She is not comfortable of touch. This was shown very much in earlier episodes. With Arjun Maya feels secure when he rescues her from lift, she feels as if her mother calling her.
Second is Maya is loyal to her 7th vow. She will love Arjun till her last breath. As a married woman she very well knows what that vow means. So a staged rape attempt breaks that vow, but I feel atleast an illusion of breaking that vow is needed for story to move forward.
