Tinno-the child does have rights to parents property,n shivani dint mean legality is nt at important ,she just told her dat her kid doesnt deserve the punishment,there is no fault of kid,watever she said was absolutely right,she has seen life,life,relations r much more imp then legality,ilegality.we run behind money,Money is imp but beyond money imp things exists right.

Gauri really only changed her mind to have the baby as soon as the mentor mentioned that her child can still get the property etc. Soon as she heard it the tears stopped and a big smile came on her face. Did she marry for love or Haveli status?

Even as the mentor heard Gauri's story you would definately pick fault with like why didn't she question Gauri about why she didn't finding out what the legal status of Jagya and Anandi's marriage before getting married? Why did you marry such a liar? The fact she didn't question it seemed like she really didn't really care and just said stuff to please Gauri. Mind you even if the mentor criticized Gauri's actions Gauri would think shes ganging up on her too. Problem is Gauri thinks shes always right if someone points out shes wrong she makes them an enemy.

1. grandparents dont even want to see grandchild or acknowledge existence. Is it right that child should covet property of people who dont want it and hate its parents and act as if child does not exist or is some sort of bad news? Why is all of this tied to haveli and property of dadisa? illegitimate children have complete haq over their parents earnings and property, so why not leave it at that. Why does gauri not say, I will earn a lot and give my child my property? what is this obsessive need of eventually having a slice of the haveli property - when haveli people hate you?
2. Money is only one part of career. Career also means reaching your fullest potential and utilizing your talent fully.

Tinno-if u check their conversation frm the begining,her main pain or tension was ilegitimate child,how wil she bring it in this world,shivani explained her dat child is child ,etc etc etc,yes she felt a relief dat injustice wont be done with her baby,now 2moro j leaves her,i m sure she wil earn n take care of her baby

As you brought the topic of ancestral property, DS's property is Jagat's and his child's ancestral property...since DS has made it on her own, her brothers/sisters cannot claim on it ...but as far as her sons/grandsons/ great-grandsons are concerned they can claim if DS don't make a will and legally disown

i agree if sum1 passes away wid no will then proprty can b claimed by remaining ppl. but if DS & bhairon passes away then basant & his wife, bhairon's wife &daughte sugana & even anandi can claim but i don't think J or his child'll get it as they've disowned him.
@bold this is the core point which CVs didn't show.i was also thinking if DS etc.'ve legally disowned him or not. even if they'd made annonce ment in newspaper like its done in such cases then child alongwid J can't claim property!! but actual thing will b known if any prsn've more knowledge abt it!!

as far as I know ancestor property can be claimed by legal son/daughter...so if JA have kids those kids can claim bt gaga kids can not...infact even gauri cant but anandi can..

I have not heard of it. Perhaps the rules have changed?

cause as far as I remember, the LEGAL wife and kids can claim the ancestral property. Because if the illegal child can claim them what if the guy has many illegal children and they all can claim to his ancestral property? Does this not encourage men to indulge in adultery. I mean Yes I know the child should get the rights as its not their fault but if this is the case, then thats a HUGE loop hole in the law


It kind of encourages men to have relationships out side of wedlock without proper closure as his (najayaz) kids will have rights anyway and he does not have to worry about their future?

I am confused.

Someone I know , a man got married to some woman and started living with her leaving his legal wife.

The kids are all grown up and when the man died his first wife took away all his property and then also his legal kids from that legal wife but the kids of this other woman got nothing when he died and she was left totally dependent on her sons.

But that was some 20+ years ago so I am not sure if a new has been introduced but this is what I know. The grandkids of that man cannot claim rights on his property though.

cause I know them personally and so far I have not heart them really trying to get hold of their 'grand dad's property based on teh fact that they are descended from the illegal relationship of their grand mum. (radical at that time)

So from what I understand..

JA Kids can claim property rights

Anandi can ( as she is the legal wife)

but JG kids cannot as they have no legal representation

ANd G certainly cannot upon the death of her husband ( oh how sweet that sounds)!!!!

g-j child can claim its father s property whether self acquired or ancestral.although they have disowned j ,there is no document or wil suporting dat,today also j can claim the property of family since he is their waris,j although disowned has the right to property,family busines,wen it comes to his kids ,they have right to parents property.

J can't claim DS's property bcoz it was created by her & not ancestral.
so theres no chance of it.only ancestral property can b claimed by J but not by G or kids as they r illegal. and any prsn who've him/herself create dthe property orv business can give 2 any1 but no1 can claim it not even their legal sons/daughters or wife!!so here DS can give 2 any1 but J & esply G& her kids don't've nay rt over DS's property!!and this is under Hindu Marriage Act !!
