Priya Sachdev Kapur achieves early win: Court orders Sunjay Kapur’s sister’s removal from assets case

The court's decision followed a complaint from Sunjay Kapur's widow, Priya Kapur, who alleged that Mandhira Kapur was attempting to involve herself in the case through an unauthorized "backdoor entry" and should not be permitted to interfere in the matter.

The Delhi High Court has clarified that Mandhira Kapur, sister of the late industrialist Sunjay Kapur, is not a party in the ongoing legal proceedings concerning her brother's estate. This clarification was issued after the court removed her name from its official records, recognizing that her presence had been mistakenly noted. The court's decision followed a complaint from Sunjay Kapur's widow, Priya Kapur, who alleged that Mandhira Kapur was attempting to involve herself in the case through an unauthorized "backdoor entry" and should not be permitted to interfere in the matter.

The court's September 10 order incorrectly recorded the presence of legal representatives for Mandhira Kapur. Priya Kapur's application stated that the inclusion of her sister-in-law's name was "factually incorrect," since she was never a party to the case.

"Upon the careful perusal of the Case History of the captioned suit...it is apparent and clear that Ms. Mandhira Kapur has not filed any application to be impleaded as a party," Priya Kapur wrote in her complaint, calling the move a "mischievous attempt to mislead" the court. She further described it as "an abuse of process of law" and a bid to create an "incorrect record."

Upon reviewing the submissions, the court acknowledged the mistake and ordered a correction of its records.

The estate case, involving assets valued at 830,000 crore, is highly contested. Following the sudden death of Sunjay Kapur, his children from his previous marriage to Karisma Kapoor are disputing a will presented by his widow, Priya Kapur. They allege the will is "forged and fabricated," claiming their father had promised to include them as beneficiaries in his family trust to ensure their financial security.

Priya Kapur maintains the will's authenticity, stating the children received 1,900 crore from the family trust before filing their suit. Rani Kapur, Sunjay Kapur's mother, has also become involved, alleging she has been disinherited and accusing Priya Kapur of selling her son's assets. The Delhi High Court has ordered Priya Kapur to fully disclose her late husband's assets.
