The Delhi High Court on Monday (October 13) revisited the high-profile inheritance dispute over late industrialist Sunjay Kapur’s will, raising questions about its authenticity. Sunjay Kapur, scion of the Sona BLW automotive group, reportedly left a Rs 30,000-crore estate.
The petitioners, Samaira and Kiaan Kapur, his children with actor Karisma Kapoor, allege that the will favouring his third wife, Priya Kapur, was “manufactured” and digitally altered. They have moved court against Priya Kapur, her son, Sunjay’s mother Rani Kapur, and Shradha Suri Marwah, named as executor of a will dated March 21, 2025.
Senior Advocate Mahesh Jethmalani, representing the children, told the court the document “was not the product of the deceased’s hand or mind” but created on another person’s device. Metadata suggests it originated from Nitin Sharma’s computer, someone with no formal connection to Sunjay. “The file was created and altered on Sharma’s system on March 17, 2025 — the very day Sunjay was in Goa with his son Kiaan. It defies logic that he would rewrite his will on holiday while disinheriting his own children,” he said.
Jethmalani added that the document was converted to a PDF on March 24, shortly before a WhatsApp group, ‘Family Office IC’, was allegedly created to circulate it among Sharma, Priya Kapur, and Dinesh Agarwal of Aureus Investment. “Two Wills were being simultaneously prepared of husband and wife. These were not mutual wills, so they have to be explained,” he said. He also questioned the chain of custody and alleged the WhatsApp documents were fabricated.
The counsel highlighted multiple discrepancies, including inconsistent bank listings, omitted properties such as Kapur’s New York apartment, a 2010 family trust, and errors in addresses and the spelling of Azarias’ name. He noted the absence of a schedule of assets, calling it “a serious procedural lapse.”
Jethmalani described Sunjay as “a devoted father and a perfectionist in both business and life” and argued it was unlikely he would exclude his children. “This will should be cast into the dustbin of history. It bears no mark of the deceased’s hand or heart,” he said.
The court observed the evidence raised “substantial questions” about the will’s authenticity and adjourned the hearing for further scrutiny of the digital trail and physical custody. Priya Kapur’s counsel denied any fabrication, citing “unimpeachable electronic evidence.”
