Noting the effect of the high court order being too harsh on the child, the Supreme Court bench said, “You have to see this case from the child’s point of view. She will be displaced from a familiar environment, familiar school and taken away to strangers.” The high court order noted that the child does not recognise her biological parents and even her school records mentioned her aunt and her husband to be her parents.
In this case there were criminal charges against the adoptive parents too for kidnapping the child from biological parents. However, the financial conditions of biological parents were not good compared to adoptive ones. Glad to know that a child’s emotional state is valued by our judiciary. 😊
I support Abhimanyu but I do think the court’s ruling was harsh for Abhir and not liking how he’s been convinced.
Well it's just one case..no court would uproot the child from a normal healthy family and hand him over to a single father . But no court can relinquish the rights of the biological father either . Shared custody would be the best judgement wherein the father can pay for the child support . Abhir would have loved abhimanyu all his life for this..
Not sure if you've seen ye hai chahtein. The custody case was sensitively handled, although it was ekta k show...the judge not only had several interactions with the child but appointed a councellor to make sure she has no issues living with her father ...
