Can somebody from India please explain whether traditional marriages in India are valid legally....................because here in South Africa tradional marriages are not legally valid....................its known at common law marriage here in SA................after the tradional wedding you still have to go to a marriage officer if there isnt one present at the wedding to register the marriage and receive a marriage certificate............marriage officers are only present at Christian weddings................OR alternatively go to an attorney to draw up a Anti Nuptual Contract (ANC)............only then you are legally bound by marriage.....................

In India traditionally marriages are valid.people though and now even the priests get you to sign some legal papers which also legally registers your wedding.
When I got married we had to go and fill some forms before the wedding, which enabled the priest to give us a certificate.This is a marriage that is registered but we also had to go to the courthouse and fill in some other forms which gave us a courthouse issued marriage certificate.

Traditional marriages are considered valid in India. We have different marriage acts according to religions and if both the bride and groom are of the same religion and marriages have happened according to that religion then it is valid. Only when you have to go abroad or any other reason that ppl do register their marriages and obtain a marriage certificate.

In the context of TD, Ds marriage holds good as the marriage was conducted according to the rituals. Actually both of them are committing bigamy right now which is invalid.

Eh Aaliyah nice topic. Off course Traditional marriage ( rather most of them are traditional marriages) are valid in India. Meme_ma I am not aware if preist ask us to sign any papers. I don't know if it is so now. I doubt. But after the marriage later, that maybe even after some months maybe people get the marriage certificate. We don't have to go to the court to get it done but can get it done through the agents ( lawyers 😊). I am sure Jingle and Twinkle maybe knowing the details about the legal procedure. But for me my Dad and Sis got it done since I had to submit the copy to come abroad. We had two copies one is the original and the other True Copy ( almost like original). But u know once while coming in the cab here my husband forgot it in the seat and now my original marriage ceritificate is missing . Jingle can u help me 😃

Aaliyah, good topic!

I was wondering the same.

Can anybody clarify the ending of the contractmarriage (CM)? I remember DK tearing the papers of CM. Does that mean the M is over. There where no laywers or court or anything, so legaly is the marriage over or what?

This is so confusing.

Here back home a religious marriage is not the same as a legal marriage.

Please clarify this for me.

Legally speaking in India there is not concept of contract marriage. It is not recognized. Pre nuptial agreements are also not valid as far as i know. So Ds marriage is still valid according to law as they also got married following the vedic rites. They need to get a divorce before they can re marry. Also for divorce there is a period of separation (i suppose 1 year) and this has also not feel fulfilled by Ds. So the present marriage amounts to bigamy by the Ds and so according to me not valid. and yes there is no need to get a marriage certificate. For normal requirements a vedic marriage is considered be legal.

Hey Kiran...............Dk burning the marriage contract couldn't have annulled the marriage..............because like Lata who lost her original marriage certificate...........You can always make an application for copy......

😭😭ya I lost my originals ya. I have not told it to anybody here else they will make fun 😉. One friend once lost his engagement ring and so people told him to go and get engaged again 😳. Though I got mad at my hubby my parents told me not to take tension about it 😆😛. Eh Jingle 😆good that Aaliyah 😆brought out this topic , I need ur help now even more 😃

But ya as Swathi said there is no such thing like contract marriages 😕 its only to fool us these serials 😡and film people show such crap. The marriage is front of the priest or even in a temple is a proper marriage . For those who elope and go 😉they need to keep proofs to show that they are actually married. Else the certificates are only required actually if we have to come abroad and also maybe for our ration cards 😕😛 don't know for sure. I know one friend from college had eloped and got married 😳. Later we came to know that court marriages require atleast one month notice period. So this smart chick and her BF had gone and registered at the court one month prior and got married on the sly in front of some witness friends and only later she dropped the bombshell after her exams and left a note for her parents that she was married and went away......oof Even in real life such filmy things do happen 😛. Now all well that ends well the parents dote on their son -in-law and have accepted him compleltely since after all every parent want their children to be happy.😆. Sorry this post went completely out of track ( Patri se uttar gayi ) Thanks for reading it anyways 😳😃
