the modis have to file a complaint after 7 years at a police station n then get a court order to declare to that the person is dead. as per section 108 of the indian evidence act 1872. This usually takes 6 months to process.
"Person is presumed to be dead who is unheard of for more than seven years by those who would naturally have heard of him/her if he/she had been alive".
