Inside the community hall the court had been adjourned. One side there is community members & other side it had been arranged for the people who came to attended hearing. Zoya sat with dilshad & najma in front. Instead of court boxes there is only a chair in front of the judge. The judge had been sat in the center & he had provided a table & chair, his attender is standing next to him. Both the advocates have been provided an individual table( small one) & chair which is near to chair for the person to be called in front of the judge.
Adv. anjana Mehra stood up & wished the court ( imagine mansi selvi - avantika divan of pyaar ka dard, playing the role)
Adv: your majesty, two days back this case was filed by miss.zoya farooqui, 21yr old nri girl against mr.asad Ahmed khan,Ayaan Ahmed khan & shireen Ahmed khan for forced marriage. My lord I would like to call miss.zoya farooqui to give her statement.

Zoya came in front of judge & she sat on the chair in front of judge. Her face was calm. She was made to give the oath that she will say only truth in front of the court.
Adv: miss.zoya please explain in front of the court about your petition & the circumstances which made you to file this case.
Zoya: your majesty, I am a orphan. 17yrs back I lost my ammi in a fire accident & I was only 3 yr old kid at that time, I have never seen my abbu. I don't even know his name. I was in a orphanage upto 6 yrs of age. My mothers close friend saw me in the orphanage & adopted me. I was brought up by her daughter & son in law in New York for the past 14 yrs. they are like my own mom & dad. Almost 5 months back I finished my graduation from NIT in electronics and computer engineering. I always wanted to know about my abbu & what had happened to my ammi 17yrs back. So I came to Bhopal in search of my abbu. Since I was adopted from an orphanage in the outskirts of this city I feel like my past is also joined in this city. After a long argument with my foster parents I came to Bhopal in search of my abbu. Dilshad phupi mr.asad Ahmed khan's mother was a distant relative of my jeju. He had arranged my stay in there house since he was worried about my safety. For the past 4 1/2 months I have been staying in that house. Phupi was just like my ammi whom I lost 17 yrs ago & najma phupi's daughter was my best friend & sister. They loved me a lot. Initially me & mr.khan didn't like each other just because we were too different from each other & extremely opposite in nature. But eventually we both fall in love but hesitated to confess because of our ego. It was that time tanveer came into KV. She was there family friend & mr.khan's childhood friend. She was so polite,matured & perfect women material. Almost 2 months back phupi realized our feelings for each other & she fixed our nikkah. Even though we both were confused initially we were happy when the nikkah day was progressing. But in between those days there were some unnatural things happened in KV. There had been few murder attempts for me & sometimes against tanveer. Most weird part was all this happens when me & mr.khan are together. Tanveer said her x husband was trying to kill her. At first I also believed her but later when it repeated I started having doubt over her & when I investigate I came to see another face of tanveer. I informed mr.khan but he didn't trust me. He trusted his bestie's words. I asked tanveer directly she told me that she wants to marry mr.khan & she will marry him some how. But I trusted him, he can never cheat me. On my wedding day we all wear waiting for mr.khan to arrive. But after a long time I received a call from tanveer & she said they are together. I didn't believe her. I went to that place & I saw tanveer and mr.khan in intimate position. I was totally shattered. I went away from here. Almost one month I was in an orphanage without informing anyone I was staying there. But when I saw him there I went away to Ajmer dargha. But accidentally we met there again. He confessed that he loves me & that night what happened he was not in conscious state. I was too hurt I went away without answering him. Tanveer was following us. She confessed to me that she had drugged & trapped him. Just because I came to know the truth she tried to kill me but I escaped & came back to KV. We both were ready to get married again but tanveer trapped him saying that she is pregnant. He called off the wedding. Intially I was unaware of this but when I came to know about it I was sure it was a trap and at that time I got her real pregnancy report saying that she is 3 months pregnant. Tanveer tried to kill me again but mr.khan came there on time. He heard everything from her bestie's mouth itself. Since it was the begin of Ramzan & she was pregnant he asked her to leave KV. We were happy. After eid we were set to marry. Phupi wanted najma's nikkah also along with us. Najma revealed her long lost love with Imran. We fixed there nikkah along with us. On najran's engagement day I saw tanveer in KV & she was talking to Imran I got scared & when I asked him he said he don't know her she was casually talking. I warned him. On my wedding day najma gave me her phone when she was talking to Imran, I heard on the other side Imran talking in his land line to tanveer & he was asked to met in a old clinic. I was scared. I felt like she was trying to trap Imran also. I didn't have time to inform anyone. So I went there only to find tanveer with some gunds who tied me tried to inject poison & kill me. Some how I managed to escape from there. But the gundas were following me. I ran and some how reach the community hall. They were following me. I didn't know that community nikkah is going on there. So I covered & sat there. I received mr.khan's call. I was talking to him & trying to explain him the situation before I could I heard someone congratulating me. I was shocked to see Ayaan & Malvi. Even Ayaan was shocked. We felt it like a joke & I went back to KV. I was about to explain mr.khan what had exactly happened suddenly Ayaan came there. He said his sister nikhat's wedding had been called off because of me & him & NikhAt tried to commit suicide. To save her marriage he asked me as a loan from mr.khan for few days till NikhAt gets married. I tried to explain mr.khan that was not a nikkah. He didn't listen to me he forcefully dragged me to sm & emotionally blackmailed me to sign nikkahnaamma. I was totally shattered when I found that he left me & went. I told Ayaan that I want to go back to KV. But he informed me that I have to stay there as his wife till NikhAt gets married & after that I can go back to KV. He didn't want to risk nikhat's marriage and so he asked me to keep it as a secret between us. I was shocked & it doubled when he told me that he had already spoke with mr.khan & he agreed to it. I was totally broken. Nikkah is not a game to me. It's a life long commitment kept between two hearts. I can't fake like Ayaan told. My love & my friend used me. No one spoke for me. No one asked what I want? I felt like I became an orphan. I can't fake as ayaan's wife & live in that house so I tried to commit suicide. But I was saved. When I came back to life I was determined that I will prove my innocence & I will fight for my rights. So I filed this case for justice.
There was pin drop silence in the hall. Asad's eyes were filled with tears. Hardly he could see anything. He had put his love through so much in her life. It was he who is a misfit in her life. He felt like he should be hanged to death.
Adv: your majesty you have heard everything from zoya. Here iam submitting the call record of zoya on her wedding day along with the location & time. In this the location of the clinic, the timings till she was there & the timings when was in community hall & the timings till she spoke with mr.asad has been highlighted.

Ayaan: what all zoya had said was true
Adv: so you agreed that you have forced her into this marriage. Can you please explain us in detail?
Ayaan: my lord. Mr.asad Ahmed khan is my step brother. Even though my abbu is not in touch with him, I used to meet him secretly without anyone's knowledge. He is like a father figure to me. Before knowing that zoya was bhaijaan's guest I have met her & we have become good friends. It was she who helped to realize my feelings for Humeira my childhood friend. I was really happy for her & bhaijaan when there marriage was fixed. Me & my fianc humiera had gone out to collect wedding gifts for them. I noticed that someone was following us. It was a thief called vikram who tried to misbehave with my fianc, whom I caught red handed & thrown out. He came with a group of friends & tried to hurt me & Humeira. We both ran & somehow we reached the community hall. I made Humeira to sit in a safe place & I went out tried to call someone for help. But I saw vikram & his friends there. So I covered my face with a sehera which I found lying there & sat there without knowing that nikkah ceremony is going on. I received a call from my abbu. I was talking to him & I heard someone congratulating me. I was shocked to see zoya & Malvi was congratulating on our nikkah. I felt it as a joke. I told the same to zoya & asked her go back to KV. When I went back to sm the community members came there informing my marriage & I had to reveal the truth. The members were creating problems & at the same time haseena bee came & called of nikhat's wedding. Previously her alliance had broken. Now this also broke because of me. She was totally broken & tried to kill herself. I felt guilty by seeing her state. I could think only about her at the moment & I had find only one way to save her nikkah was bringing zoya as my wife. I went & requested to my bhaijaan. It was because of me bhaijaan forced zoya. I am the culprit. I admit zoya was treated badly by us. My lord I am ready to accept any punishment but don't include my bhaijaan & ammi. It's all because of me.

Asad: my lord. What all zoya said is true. 17yrs back my abbu left my ammi for another women. I have seen my ammi's misery & I worked hard in my life to be a sucessfull businessman. I didn't believe in love till I met zoya. Even though initially I used to fight with her but slowly she changed my concepts & view. I had fall in love with her. I had hurt her always. But she always used to understand me & forgive me without any complaints. I was happy to start a new life with her after all the obstacles. But then Ayaan came & informed about all the mess & NikhAt tried to kill herself. If I want to save NikhAt I had to give away my love. I was never in such a dilemma in my life. I may hate my abbu but I love my siblings like my own kids. I couldn't imagine to lose NikhAt & Ayaan because of my actions. At the moment I want to save my sister. So I had to force zoya in to all this.
Adv: mr.asad Ahmed khan, you tried to save your sisters life but your action spoiled 2 girls life. Zoya & humiera. Just because zoya loves you & trust you, you can't take descion about her life. She has full freedom to live her life according to her wish. Your action had hurted zoya's self respect. She is a grown up girl, not a doll so that you can lend her to your brother. Just because zoya is an orphan you allowed all this. I am sure if it was your sister in zoya's place you would have burnt the entire world for her. Am I correct?
Asad didn't say anything. He was feeling ashamed of himself. Next it was shireen who had been called. Shireen was crying & she was totally scared. Adv.anjana told her not be scared & say the truth.
Shireen: I was shocked initially hearing about zoyaan. But we didn't have any other choice. All the senior committee members were there. It was our prestige issue. And on top of that my daughter's life had been in danger. Her nikkah had been called off. After so many hardships her nikkah was fixed & it was broken. My NikhAt tried to kill herself. That too twice. I had to beg asad to give zoya for my nikhat's life. I know we did wrong towards zoya. But I had no other go. At least for my kids please forgive me. Please try to understand a mother's pov.
Adv: wow mrs.khan! You are saying about a mothers pov. Zoya is also your daughters age. Even after knowing that asya & ayra loves each other you wanted zoya as your dil to save your NikhAt & pride. You are talking about pride? Where was your pride 17 yrs back when you married rashid Ahmed khan who is dilshad khan's husband!
Shireen was toungetied. She was embarrassed in front of the court by advocates questions. Next dilshad was been called
Dilshad: my lord 17 yrs I was alone in my life. My husband left me & remarried. I had only this 2 kids. I worked day & night for giving them better life. I was happy with my son's sucess. I felt like I have given good upbringing to my kids. When zoya came to KV she filled our lives with happiness. I understood asad & zoya loves each other & fixed there nikkah. But I was really disappointed with my son when I came to know that he forced zoya to sign nikkahnaamma with Ayaan. I came to know much later. If I knew at first I would have never allowed him. He questioned my upbringing. He insulted a women who loved him more than her life. He had committed a sin. I can never forgive him for that.
Adv: my lord now we have finished with everyone's statement I would like to provide some evidences In court. My lord this is the register of the community nikkah. Here if you want to get married you have to register before itself & just before the nikkah Malvi should re register personally by asking them individually. In this register both have not done for zoya & Ayaan. In fact there names are also not there. Please have a look your majesty.

Adv: my lord! This is the video cd of that community nikkah. I would like to play it my lord.

Soon it was arranged for the video cd to be played. It was clearly shown that zoya has ran & came inside & few men were after her. She was scared & she saw the a girl leaving her veil & going somewhere talking in her cell phone. A scared zoya covered her face & sat there. When Malvi came near her, it was clearly seen that she was talking in phone & the same goes with Ayaan. He was also in phone when Malvi was near to him. Zoyaan was shocked to see each other when Malvi congratulated them.
Adv: my lord! You can co relate the time in the video when the Malvi was reading nikkahnaamma & zoyaan's cell phone records timing match each other. So it was clear that zoyaan was in phone when Malvi was reading nikkahnaamma. According to Islam when marriage ceremony is going on prescence of mind is necessary to consider it as a valid nikkah.
My lord! I request you re play the video were Malvi is reading the nikkahnaamma to Ayaan.

Adv: my lord! According to Islam you should ask trice do you agree to this nikkah & you should reply thrice individually that too qubool hai. But here Ayaan was asked only once & he had not even replayed qubool hai.

Please note the words of Malvi in nikkahnaamma " zoya fareed daughter of fareed quadri, do you accept this marriage with Ayaan Ahmed khan". My lord! Zoya's identity is zoya farooqui & her guardian is her foster father anwar farooqui. Even in nikkahnaamma zoya is addressed as zoya fareed daughter of fareed quadri & it was signed as zoya farooqui. According to Islam for a valid marriage the brides name & her guardians name must be correct & it should be according to legal identity documents. So here I submit the nikkahnaamma & zoya's passport.
Both were verified by judge. Those who were present in the hall was sitting with the expression like as if they have seen ghost except for zoya. She was unaware of all this chaos happened in the community hall. But she was sure something was there which was unrevealed & that's the main reason for her to file this case. Asyaan was feeling ashamed of themselves. Without knowing the truth they have jumped in to pit.
Adv: my lord! The truth is not yet revealed. Please grant me permission to play one more video cd.

When the video started to play every one was shocked what they have seen in the tv screen.
