"PRITHVIRAJ CHAUHAN CONTEST" RULES AND REGULATIONS


"PRITHVIRAJ CHAUHAN CONTEST" ("Contest") will be held on STAR Plus ("Channel") in relation to the program titled "Prithviraj Chauhan" ("Program") as stated hereunder:

1. The Contest will be held from October 15, 2007 at 8.00 A.M, to October 20, 2007 ("Period") (both dates inclusive).

2. The Contest shall be held only in the following cities in India:

2.1 Ahmedabad in Gujrat.
2.2 Surat in Gujrat.
2.3 Baroda in Gujrat.
2.4 Bhavnagar in Gujrat.
2.5 Jamnagar in Gujrat.
2.6 Rajkot in Gujrat.
2.7 Bhopal in Madhya Pradesh.
2.8 Indore in Madhya Pradesh.
2.9 Jabalpur in Madhya Pradesh.
2.10 Burhanpur in Madhya Pradesh.
2.11 Ujjain in Madhya Pradesh. ("Cities").

STAR India Private Limited ("STAR India") and/or STAR Plus ("Channel") may change the name of the cities and/or states stated above without any prior intimation to the viewers.

3. The Contest shall be held through schools in the Cities. The schools interested in participating in the Contest should log on www.indya.com.

4. The selection of the schools for each city shall be on first come first basis in the following manner:

4.1 Indore - First 30 schools who have registered shall be eligible to participate in the Contest from that city.
4.2 Bhopal - First 30 schools who have registered shall be eligible to participate in the Contest from that city.
4.3 Ujjain - Indore - First 15 schools who have registered shall be eligible to participate in the Contest from that city.
4.4 Jabalpur - First 20 schools who have registered shall be eligible to participate in the Contest from that city.
4.5 Bhurhapur - First 15 schools who have registered shall be eligible to participate in the Contest from that city.
4.6 Ahmedabad - First 30 schools who have registered shall be eligible to participate in the Contest from that city.
4.7 Rajkot - First 20 schools who have registered shall be eligible to participate in the Contest from that city.
4.8 Surat - First 20 schools who have registered shall be eligible to participate in the Contest from that city.
4.9 Baroda - First 20 schools who have registered shall be eligible to participate in the Contest from that city.
4.10 Bhavnagar- First 15 schools who have registered shall be eligible to participate in the Contest from that city.
4.11 Jamnagar- First 15 schools who have registered shall be eligible to participate in the Contest from that city.

The decisions of STAR India and/or the Channel in connection to the eligibility of a school to participate in the Contest shall be final and binding. Once the school registers on the website as stated rule 4 above, the school cannot withdraw its registration.

5. Registrations for the Contest received after the Period shall not be considered and shall be null and void.

6. Multiple registrations for one school will not be allowed.

7. Each school will have four 7 teams, and each team will have only two entries (one (1) boy and one (1) girl). Each team will be selected by pairing students of (i) 6th standard (ii) 7th and (III)8th standard (iv) 9th and (v) 10th standard and (vi)11th and (vii) 12th standard and thus, the seven (7) selected teams ("Contestants") will compete among themselves for level one (1) in the following rounds:

Round 1: The Contestants from each team shall participate in a quiz based on the Program and score points. Therefore, it is necessary that the Contestants watch the Program. It shall be the sole responsibility of the Contestant(s) to check the days and time at which the Program is telecast on the Channel(s).

Round 2: The Contestants from each team shall participate in the push up competition for boys and arm wrestling/ skipping/ bow and aoorw competition for girls and score points.

Once a particular team is registered by the school, the school cannot change the members of team(s) and that team would continue to participate, if selected, till the end of the Contest.

Each team scoring maximum points shall be selected for the next level. The selection process for level one (1) shall be done by the school.

8. The top five (5) scoring schools in each city will participate in level two (2) in which, each team representing their school will compete with other teams representing their respective schools from the same city. STAR India shall have the sole right to decide the teams that are eligible to participate in the level two (2) of the Contest.

Level two (2) or City Finals shall be divided into two (2) rounds:
Round 1: The Contestants from each team shall answer the questions asked in the quiz related to the Program and score points.

Round 2: The Contestants from each team shall participate in blind fold bow and arrow and score points.

The team representing their school and scoring maximum points will be declared as city finalist(s).

9. All the eleven (11) city finalists selected from each city will be declared as Winner(s) of the Contest who Star India believes have scored the maximum points. Star India shall solely have the right to select the Winner(s) and none of the contestant(s) or their natural and/or legal guardian shall be entitled to dispute the decision made by Star India.

10. There shall be total eleven (11) Winner(s) each from one (1) city from the Cities stated hereinabove selected by STAR India.

11. The Winner(s) or their natural or legal guardian shall be informed/contacted by STAR India. Upon being informed that the contestant(s) is the Winner(s), the guardian must submit such documents as may be required by STAR India and/or the Channel including but not limited to a letter from the school that the contestant(s) the contestant is the student of that school, is representing the school, was eligible to participate in the Contest and has been declared the Winner(s) of the Contest.

12. Each of the Winner(s) shall get an opportunity to be a part of the Program by acting in the Program which may be telecast on the Channel ("Prize"). For avoidance of doubt it is clarified that STAR India and/or the Channel is not obligated to telecast that episode of the Program.

13. The sets of the Program are located in Baroda. Therefore, in the event the contestant(s) is selected as the Winner(s) of the Contest, the Winner(s) would have to travel to Baroda. Since the Winner(s) shall be a minor, the Winner(s) shall be accompanied by the Winner(s)'s parents/ legal guardian ("Companion").

14. STAR India and/or the Channel(s) will decide the shoot dates of the Program(s) stated in rule 12 herein above.

15. In the event, the Winner(s) and his/her Companion resides outside Baroda, the Winner(s) and his/her Companion shall also be eligible to the following:

15.1 One economy class air ticket to Baroda and back to the city in which the Winner(s) resides. STAR India shall solely have the right to decide the airline that the Winner(s) and his/her Companion shall travel and this decision of STAR India shall be final and binding on the Winner(s).

15.2 A hotel stay located in Baroda for a period as may be decided by STAR India and/or Channel. The Winner(s) and the Companion will also be provided breakfast, lunch and dinner during their stay in Baroda. The hotel would be chosen by STAR India and the decision of STAR India in this regard shall be final and binding.

16. In the event, the Winner(s) cannot travel and shoot for the Program on the date(s) on which STAR India has decided as stated in rule 14 herein above, STAR India shall be entitled to forfeit the Prize and/or announce somebody else as the Winner (s) of the Contest.

17. Save and except as stated in rule 15 herein above, all and any incidental costs (direct and/or indirect ), in relation to the Prize, including but not limited to any STD/ISD/local calls and/or any other services used by the Winner(s) (as the case may be) in the hotel and also during their travel in and to Baroda, shall be borne by the natural guardian and/or the legal guardian of the Winner(s) and in no manner whatsoever shall the STAR India be held responsible for the same.

18. Neither the Winner(s) nor the Winner(s) guardian or any person claiming under them shall at any point of time be entitled to and/or claim any compensation, monetary or otherwise for the performance/acting of the Winner(s) in the Program. By participation of the Winner(s) in the Contest, it shall be deemed that the guardian of the Winner(s) has assigned all the intellectual property rights in and to the performance of the Winner(s) in the Program in favour of STAR India world wide and in perpetuity and that STAR India shall be the owner of the same.

19. Neither the Winner(s) nor the Companion shall be allowed to stay longer in the hotel beyond the stay of two (2) days and/or change the airline. In the event, the Winner(s) or the Companion decides to deviate from the Prize, the natural guardian and/or the legal guardian of the Winner(s) would have to bear all such costs, charges, risks and expenses in connection thereof.

20. Neither STAR India nor the Channel(s) nor its employees have given a guarantee and/or warranty etc. regarding the services to be offered by the hotels, airlines etc. and neither STAR India nor the Channel(s) nor its employees shall be responsible for any reason whatsoever in connection thereto.

21. Neither the Companion nor the natural guardian nor the legal guardian of the Winner(s) shall raise any dispute with regard to the Contest including but not limited to the selection of the Winner(s) etc.

22. STAR India and/or the Channel(s) reserve the right to at any time to withdraw the Contest without giving any prior notice thereof.

23. Companion shall be solely responsible for the safety of the Winner(s) and shall at all times be with the Winner(s), take care of the Winner(s) and fulfill all the needs of the Winner(s). The Companion of the Winner(s) shall at all time keep STAR INDIA and/or the Channel(s) indemnified in connection thereto.

General Rules

1. The contestant(s) should be citizens of India, residing in India and below the age of 18 years of age to qualify for the Contest.

2. Neither the contestant(s) nor the parent(s) and the Companion should have any criminal conviction.

3. Proof of age is a must for the contestant(s), the Companion must be submitted to the Channel(s)/ STAR India (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

4. STAR India and/or the Channel(s) reserve all rights to make amendments to the existing rules without prior notice.

5. Non-conformance by any contestant(s) and/or the Winner(s) and/or the natural or legal guardian of the contestant(s) and/or the Winner(s) and/or the Companion of the rules of the Contest will disqualify the contestant(s) or the Winner(s) from participation or winnings, immediately, as the case may be.

6. STAR India may in its sole discretion exclude a contestant(s) from participation in the Contest which may include without limitation (i) circumstances which, in STAR India's view, renders the contestant(s) unfit to participate therein; (ii) inability to produce documentation required by STAR India and/or the Channel(s) in the rules and/or at any given point of the time. STAR INDIA may in its sole discretion exclude a Companion from accompanying the Winner(s). Upon receipt of such a notice from STAR INDIA and/or the Channel(s)., the parent(s) shall immediately replace the Companion with another companion.

7. STAR India reserves the right to cancel the entry of the contestant(s) for any reason whatsoever. For avoidance of doubt, the disqualified contestant(s) or the Companion agrees that all the intellectual property rights in and to the Contest shall continue to vest with STAR India for worldwide and in perpetuity, without any consideration payable to the disqualified contestant(s).

8. STAR India and/or the Channel(s) may refuse the contestant(s) from participating in the Contest in the event of his/her fraud, dishonesty or non-entitlement to participate in the Contest under this rules and regulations.

9. All contestant(s), the Winner(s), the Companion of the winner(s) of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel(s) and/or STAR India and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Winner(s). Further, neither the contestant(s) nor the Winners nor the Companion(s) shall at any point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The legal guardian and the Companion of the contestant(s) and the Winner(s) agree that the footage of any nature with regard to the Winner(s) and/or the Companion shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

10. The natural guardian and/or the legal guardian of the Winner(s) shall be responsible to collect the Prize from STAR India. The natural guardian and/or the legal guardian of the Winner(s) agree that the Prize cannot be exchanged with other items and/or exchanged for cash equivalent. The natural guardian and/or the legal guardian of the Winner(s) further agree that he/she shall not dispute the value of the Prize so offered to the Winner(s) upon the Winner(s) winning the Contest. If the natural guardian and/or the legal guardian of the Winner(s) refuse to accept the Prize offered, the Channel(s) and/or STAR India shall be released from all obligations towards the natural guardian and/or the legal guardian of the Winner(s) in connection to the Prize won by the Winner(s).

11. STAR India and/or the Channel(s) shall have irrevocably rights to the Contest and/or participation of the contestant(s) including all the activities of the contestant(s) during their participation in the Contest including but not limited to the Winner(s) visit to the sets etc., being filmed and/or recorded and/or broadcast on the Channel(s) or any other channel that STAR India and/or any other channel, which STAR India and/or the Channel(s) may deem fit. Further, the natural guardian and/or the legal guardian of the contestant(s) shall permit STAR India and/or Channel(s) to use of the contestant(s)'s name, likeness and private life to be included in the subject matter of the Contest and any related publicity, advertising, magazine material and/or otherwise. Further STAR India and/or Channel(s) shall have full right to the footage of any nature in relation to this Contest and all such rights shall at all times vest with STAR India, including but not limited to all intellectual property rights, copyrights and any other rights, in any and all media, worldwide and in perpetuity. It can be arranged, re-arranged, added to other material without any payments to me.

12. Notwithstanding a contestant(s) participation in the Contest there is no obligation on the part of STAR India to broadcast the Contest in which he/she has taken part, or any or all of his / her contribution as recorded by STAR India.

13. The contestant(s) of the Contest and its natural/legal guardian and the Companion of the winner(s) agrees that he/she shall hold harmless the Channel(s), STAR India, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Contest and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel(s) and/or STAR India to claim any damages or relief's.

14. The Winner(s) of the Contest including their natural/legal guardian agree that he/she shall hold harmless the Channel(s), STAR India, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her in any manner, whatsoever, in connection with the Prize and that the Winner(s) shall also not file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel(s) and/or STAR India to claim any damages or relief's or otherwise.

15. The natural guardian and/or the legal guardian and/or the Winner(s) agree that if due to any reason, whatsoever, beyond the control of the Channel(s) and/or STAR India, the Prize and/or anything in connection to the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, neither the Channel(s) nor STAR India shall be responsible for the same.

16. The Channel(s) and/or STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Winner(s) or the Companion or any person in connection to them in any manner whatsoever, including but not limited to the Contest and/or Prize.

17. Employees of the Channel(s), STAR India, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to enter the Contest.

18. The contestant(s) including the Winner(s), companion of the Winner and their natural and/or legal guardian shall abide to the laws of India including Income Tax Act, 1961. STAR India and/or the Channel(s) will not be liable for non-compliance of any laws by the Winner(s) and their natural and/or legal guardian in India and the natural guardian and/or the legal guardian as well as the Winner(s) shall indemnify and hold harmless the Channel(s) and/or STAR India in relation thereto.

19. Participation of the contestant(s) in the Contest shall be construed that the contestant(s) and his natural guardian and/or his/her legal guardian and/or the Companion has waived their rights to dispute any decision(s) made by STAR India and/or the Channel(s) in connection to the Contest and that the contestant(s) and his/her natural guardian and/or legal guardian agrees to all the decision(s) made by STAR India and/or the Channel(s) and that all the decision shall be final and binding upon the contestant(s), his natural guardian and/or the legal guardian. No correspondence in this regard shall be entertained.

20. Since the contestant(s) and the Winner(s) shall be a minor, the natural guardian and/or the legal guardian shall do any and all acts and execute any and all documents on behalf of the minor in such manner and at such location as may be required by STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India herein. The Companion of the Winner(s) shall also do any and all acts and execute any and all documents at such location as may be required by STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India herein.

21. All acts done by the contestant(s) in the Contest shall be construed that the contestant(s) has done those acts in consultation and approval of his/her natural guardian and/or legal guardian and/or the Companion. All acts done by the contestant(s) in connection to the Contest shall be construed to be performed by his/her natural guardian and/or legal guardian and/or the Companion.

22. Neither STAR India nor the Channel(s) shall be responsible to pay for any taxes, custom duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the Prize and the same shall be solely borne by the Winner(s). A copy of the receipt (challan) confirming the payment of such taxes, charges, license fees and/or levies thereto shall be furnished by the Winner(s) to STAR India.

23. The participation of the contestant(s) in the Contest shall mean that the natural guardian and/or the legal guardian and/or the Companion of the contestant(s) has read, understood, accepted and agreed to abide with all the rules including the general rules of the Contest. Further, the natural guardian and/or the legal guardian of the contestant(s) and/or the Companion has explained the rules and regulation to the contestant(s) and the same has been understood by the contestant(s).

24. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the natural and/or the legal guardian of the contestant(s) who has raised the dispute.

25. Subject to rule 24, only courts of Mumbai shall have the sole right to decide any dispute in connection to this Contest.
