MUMBAI: An activist filed a new complaint on Thursday against Bollywood couple Shah Rukh andGauri Khan, as well as the civic authorities for allegedly violating sections of the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex selection) Act.
The actor's third child was reportedly delivered by a surrogate mother at Masrani Hospital in Andheri on May 27. The baby was born prematurely at 34 weeks of pregnancy.
Controversy has been raging ever since reports in a section of the media indicated that the baby's gender had been determined before birth. The law prohibits sex determination and sex selection.
Social activist and lawyer Varsha Deshpande had raised questions following which the civic authorities visited the actor's residence on June 17 to find out if sex-determination techniques had indeed been used before the child's birth.
In the new complaint, Deshpande sought a copy of the report to be prepared following official probe. Deshpande said the copy should have been furnished to her as she was the complainant. "These documents are very essential and important for the just decision of the case.
"These documents are to be made available within 24 hours, for a just decision of the case, and irreparable loss will be sustained by the complainant and merits of the case," she said.
Additional chief metropolitan magistrate Uday Padwad will hear the matter on September 12. Notices have been issued to the Khans, the BMC commissioner, health officer, (health department), Maharashtra State Appropriate Authority, Jaslok Hospital and an IVF expert.

Sex determination is redundant: Shah Rukh Khan

The Indian Medical Association (IMA) had slammed the actor over reports that he and his wife Gauri Khan had got a sex determination test for the baby. However, Shah Rukh had denied any such activity via an official statement in July, when he had confirmed the birth of the baby.
"Sex determination is redundant," Shah Rukh said at a press conference at his residence here to celebrate Eid.
He said he has been trying to cover up all such controversies in his life with happy moments.
"I am trying to cover all that up with happy moments. My son is born and Inshallah, he will be well. Being in the public eye is a part and parcel of life, we will go on doing it. Sex determination is redundant. I don't know how the lawyers will deal with it (case). I hope I am not called often," Shah Rukh told the media
The actor said that his newborn baby makes him very happy.
"He is very small right now. We request him to pray for the health of the family as he is closest to god. It is a fact that I am happy because of him," said the actor, whose film " Chennai Express"also released Friday.
