Hi friends,

I'm sure there are many members in the forum who know the Indian laws. Could anyone who has studied law or knows it well enlighten us on this,Please.

Can an accused be arrested for rape merely on the basis of a statement given by the "victim" ?

Today with science being able to prove the accused person's innocence or guilt, is it still a procedure that's carried out after the arrest?

I would like to know this before I state that Ajai Sinha has shown something very absurd.

Please take time out and reply to this query.

Thanks and Cheers

Akshata

Not sure about the rest of India, but here in the state of Mizoram, there needs to be physical evidence before an arrest. However, the person accused must take a DNA test.

Anything can happen in Astitva! There's no point applying brains here cause the director has lost his brains. Sinha has proved that several times and I think we should not insult him more by asking questions who he does not have answer.

I think Simran has got so very confused in mind that she is not even demanding a report from the officer , asto whether the girl was really raped or not... and what is this officer trying to prove? Is it not a pre-requisite for the officer to have the girl tested, asto whether she was raped or not? How can one arrest a person without even having the evidence that the lady was raped? Is this believable? Certainly not!!!😕

I had genuinely wanted to know what the law says.Maybe I asked in the wrong section. 😕

I shouldn't have written "I would like to know this before I state that Ajai Sinha has shown something very absurd." As I went through all the posts,I realised that it sounded a bit saracastic. My apologies for that;really not intended that way.

As for wasting one's brain and energy,I'm doing so for a serial I like and enjoyed. How can someone who finds nothing good about the serial want to spare so much time running it down all the time? 😉

But I shall definitely pray that he doesn't extend the serial. 😊
cheers,

I understand that your question was genuinely about knowing the law 😃
Nobody can think of "logic" in Astitva now. 😆

In India, apparently rape is one crime where the accused is presumed "guilty until proved innocent" unlike the general law of "innocent until proven guilty"!

Sinha did this because he wants to wrap up the serial - PLEASE PLEASE do not give him any ideas here that he will go on extending the show.

Please do not waste you brain and energy on what Sinha is trying to show - it is all illogical and absurd. Pray to God that he sticks to his words to ending the serial in January' 06.

That was very funny😆😆
