If the child is grown up, he is asked to choose between mother and father . Correct me if I'm wrong. The court generally awards the child custody to the mother , specially a young 5 yr old child.

In most cases , court gives custody to mother if she can give basic middle class life and they give father visiting rights. Father can visit child whenever they want.
For court and law , child’s biological parents will always remain child’s parents and child’s step father or step mother are coparents for them.
In families or in real couples we can see this clearly. If we have not seen such cases in family then we can see it in society around us. For eg. look at Charu asopa, her husband comes from wealthy family and she comes from not so wealthy background, they are proceeding for divorce but she has child with her to raise and their daughter ziana’s father can visit her anytime he wants.Tomorrow if Charu married to someone else then also Charu -Rajeev will always remain ziana’s parents irrespective to marital disputes and ugly divorce on public platform. Same we can see with Karishma Kapoor too. She has her children with her post divorce and ex-husband has visiting rights. Their divorce was quite ugly. Daljeit Kaur was also not so wealthy and was quite middle class when she got divorce from Shalin Bhanot.
Now at other end karan Mehra’s divorce where he wants child’s custody because his ex-wife is suffering from bipolar disorder and according to him child is not safe with his mother. Nothing is proven yet and their son is with nisha.
Agar Abhimanyu Akshara ko mentally unstable prove karta hai toh usko custody mil sakta hai otherwise it’s clear that mother will get custody and father will have visiting rights .
Yaha ek bahot bada point hai jo Akshara ke favour mai bilkul nahi hai I.e Akshara didn’t inform child’s existence to Ex-husband even after meeting him personally. Court doesn’t give damn to old telephonic attempts. Yaha sab bol rahe hai ki Akshara ka case bahot strong hai lekin agar kisi lawye ke pass jaoge toh samaj ayega ki yeh case charu asopa/juhi Parmar/daljeit Kaur jaisa nahi hai. Lekin fir bhi custody mother ko he mil sakta hai with father has visiting rights.
They don’t think much about child’s step-parent/coparent when giving visiting rights to child’s mother:father.
As per court and law , abhir is not anyone’s adopted child. For court, Step father is raising abhir since birth and father was clueless about child’s existence.
Adoptive parents and unke rights ka point tab aata hai jab baccha adopted ho.
Yaha abhir is not anyone’s adopted child at first place.
For law and court, step-father/coparent is raising abhir since birth and child’s father was not aware about child’s existence.
Well ofcourse by the law of court Abhimanyu has rights over Abhir same as Akshara and I guess can get custody even if he can successfully prove Akshu a very bad mom or something...in normal case he gets visiting rights...
But if Abhi exposes a 5-6 yrs old kid to a court case between his mom papa and docman and forcefully takes his custody or any rights over him by accusing Akshu in court...will he deserve Abhir after that? I dont think so...Sure its his right...but if he chooses not to assert his right Abhir k acchai mental health k bare mein soch k, thats when he will start deserving to be Abhir's dad...
