Supreme Court: This Court is not for those who have voices, but for those who don’t!⭐️

The Supreme Court admonished popular TV and film producer Ekta Kapoor, questioning her what kind of message she intends to convey to audiences through visual media.

The Supreme Court of India, as reported by PTI, was hearing a plea filed by Kapoor challenging the arrest warrants issued against her for allegedly insulting soldiers and hurting the sentiments of their families in the web series aired on her OTT platform ALTBalaji.


"Something has to be done. You are polluting the minds of the young generation of this country. It is available to all. OTT (Over The Top) content is available to all. What kind of choice are you providing to the people?....on the contrary, you are polluting the minds of youngsters," a bench of Justices Ajay Rastogi and C T Ravikumar said.

Wondering what kind of choice is being given to people, the Bench observed, “Every time, you travel to this court....we don't appreciate this. We will put a cost on you for filing such a petition. Mr Rohatgi please convey this to your client. Just because you can afford and hire the services of good lawyers....this court is not for those who have voices.”

"This court works for those who don't have voices...if these people who have all kinds of facilities, if they cannot get justice then think of the situation of this common man. We have seen the order, and we have our reservations," the bench observed.

Deep diving into the details of the case, PTI reported that a trial court in Bihar's Begusarai had issued the warrant on a complaint lodged by Shambhu Kumar, an ex-serviceman. Kumar, in his complaint of 2020, alleged series XXX (Season-2) was filled with objectionable scenes related to a soldier's wife.

Is the modern visual media is weakening our collective conscience, and it imposes limits that we cannot see but feel instinctively? To some extent --yes.

The clever approach to keep people docile and submissive is to carefully limit the range of permissible opinions while allowing for extremely active debate within that range... Every court decision will have advantages and downsides, but how far is freedom of expression/creativity acceptable in this highly influential visual media age?

Take any serial and chances are that Ekta Kapoor is almost certainly associated with it! However, in the process, she has depicted Indian society and family in a way that is far from reality. These surreal, and often ludicrous, events occur so frequently in her serials that they have come to define her shows.

She came close to significantly changing the social fabric of the family relationships!!

Ekta Kapoor is the queen of TV. She has redefined TV viewing for the Indian audience, produced so many TV shows that she has become synonymous to Indian Television itself!!

Here are things that you’ll always find in an Ekta Kapoor serial:

1. A huge joint family! ---- Ekta Kapoor serials are family oriented,😛 well, that means, there will be a huge family and mind you, it is always the protagonist's sasural !!

2. And the family gets so big because death can always be defied.

The young ones keep growing. Then people marry and give birth to new ones. Characters marry more than once. And old characters just defy death! Aging definitely is an alien concept!

3. I mean even when people die, they return after some episodes 🤪

I have no idea what the web series showed that allegedly "insulted soldiers" or "hurt sentiments." Until someone addresses the substance of this topic, I can only say this:


The Supreme Court's remarks are disgraceful in any context.


The plaintiff is before the court because she got arrested. She didn't start legal proceedings; she was put in jeopardy, and she has the right to a legal defense, including an appeal to a higher court. The Supreme Court may dismiss an appeal that is frivolous, but it should never reprimand anyone for exercising her right to an appeal!


Shame on the justices if they actually said, "Every time, you travel to this court....we don't appreciate this. We will put a cost on you for filing such a petition." Their personal displeasure about how many times they see this individual shouldn't enter into their judgement on the merits of her appeal.


When the Supreme Court imposes a "cost" (monetary fine? harsher sentence than trial court?) on a rich person for lodging an appeal, it has the effect of discouraging appeals by everyone who is less rich as well. This should never happen in a democracy where the courts exist to uphold the rights and freedoms of everyone, including access to justice without undue burdens.


Article 19(1)(a) of the Constitution of India gives every citizen the right to freedom of speech and expression. That applies to producers of fiction deciding whether to portray soldiers and their spouses sympathetically or critically.


Does any law entrust the Supreme Court with custody of young minds? Has the Court received an appeal, a response, or an amicus curiae brief from someone with recognized standing to represent those young minds? If not, then the Court has no business opining about "pollution" of those young minds.


It is not the responsibility of an author of fiction to give "choice" to consumers. The choice to watch or not watch is sufficient. If young people are being forced to watch degrading content by their parents, schools, co-workers etc., those entities should be held responsible, and remedies would probably come from civil court, not from arresting anybody.

I agree and disagree as well. Agree because the fundamental duty of the Supreme Court or any body that offers justice shouldn't insult or negate a citizen's right to appeal and offer their share of rebuttal. This is actually against the constitution of India.

"The presumption of innocence is a legal principle that every person accused of any crime is considered innocent until proven guilty " according to the Constitution.

I also concur that as the audience we have the option to watch or refrain from consuming content that we find disagreeable according to our personal beliefs. To insult any profession (if they have) especially such a profession that ensures the safety of a whole country is wrong but does it require such a reprimand, I don't really know.

But on the other hand, young minds are often curious and may fall into the trap of getting mislead by the promos or even blind love for the actor enacting the script (this happens many a times) might lure them into watching. It does stand to pollute young minds.

But I find the narrative a tad bit hilarious. I mean we watch shows, movies, books for ENTERTAINMENT. We don't necessarily need to have logic as a base for the story. Its fiction. They are allowed to show anything provided it complies with the body governing it, in this case the TRAI. Similarly there can be a governing body for OTT platforms too (if there isn't one already).

Fifty shades of Grey was banned from releasing in India because the CBFC deemed that the film couldn't be given an appropriate rating, meaning the explicit sexual scenes depicted were way more than the standard A rating.

We watch films, shows for a welcome distraction from our hectic lives taking up our concentration otherwise. It need not be fully logical or show only things that have an logical base. Have people seen vampires ? Or werewolves ? Have we seen paranormal creatures ? Is there any proper proof for their existence or for an alien invasion? No man can manhandle his wife so much nor is a woman that much of a doormat to act according to every whim and fancy of the so called sasural. I agree it's highly toxic and it does happen in many parts of the world, especially India. Yeah the content these days are not exactly good but then there are people still watching this. So, as long as audience we don't get cognizant about the content we consume, it's pointless to blame the producers/author of fiction.
