Ideally, he should be investigated by an Internal Affairs agency or something of that sorts. Usually a task force whose job is to investigate complaints of corruption etc by government employees. Not sure if India has one. Looks like it'll be NCB & Mumbai Police though. Don't expect much from NCB, possibly a transfer for not following protocols. Mumbai Police will definitely go all out though considering everything that has happened in the past year, the political situation in Maharashtra & the beating their reputation has taken recently. It'll be tough to prove the extortion charges regardless. But who the hell knows really, all speculation. ๐

This isnโt a matter of a civil law suit and money. This is an apparently (based on available evidence) innocent man who has been denied his freedom for 20+ days.
If this is truly just the way Indian criminal law works, every Indian citizen should be demanding an Indian Bill of Rights.
I hope you are right and Aryan will get bail soon but then I hoped (and believed) he would get it at the first hearing. Iโm not counting on it anymore.

In both Sessions and now in High, we've seen the Defense go first followed by Prosecution. Is that normal?
Additionally, the Prosecution seems to base it's case entirely on the WhatsApp messages.
Don't they have to present it as evidence to the court in order to prove that what they are asking (denial of bail) is justified?
Can they just keep saying, "we are reviewing the chats and we think there is evidence which will lead us somewhere"?

The laws are fairly similar. But Aryans bail has already been rejected in the NDPS court. His custody has also been extended by the same court. This is a "Bail Appeal". Just like the US, India also requires that the accused bought in front of the magistrate within 24 hours so as to not curb their freedom. But in case of an appeal, the accused has to wait. But every Law also has loopholes. The NCB has applied sections of the NDPS act which are non-bailable. The High Court will essentially have to throw those charges OUT to give Aryan Bail. So unfortunately its a little drawn out because its not a simple ruling. But I'm a 100% positive Aryan will get his bail by this judge. Rhea also went through something similar and the judge threw out the non bailable charges like Peddling & Harboring a Criminal. It'll happen this week.
