He could be sociopath (erratic, rage-prone) with psychopathic tendencies (i.e. ability to lead normal life).

Tbh murdering him would just make him a martyr - that whole notion of oh he was mentally imbalanced, etc etc. It doesn't really force him to pay for his crimes. It's better if they just lock him up and throw away the key.
