~Part 5~

At Sanjay's house,

Sameer and Naina are sitting on the sofa, all tensed while Sanjay goes through the documents.

Sanjay- So there are two things here. Firstly, Mr. Kamlesh has no doubt accessed the will documents from the secret room of your company and created false documents. Secondly, he has also claimed ownership to the house which once belonged to you.

Alright, I'll see what can be done about it. I need some time to think about the case. Call me tomorrow evening , I'll let you know what has to be done next.

Samaina return to their house.

Naina- Sameer , mujhe nahi pata ki yeh case kabtak solve hoga. Tabtak hum kya karenge?

Sameer- Kar hi kya sakte hai.. ghar pe baithkar makhkhiyan maarenge..

Naina(takes in a deep breath)Humein sochna hoga ki yeh ghar, iske kharche, humare kharche kaise chalenge. (And hesitantly says) Meri salary i to abhi utni nahi hai ki itna bada ghar chala sake aur dono ka kharcha..

Sameer- (visibly angry and upset at the same time)apni biwi ki kamaayi pe roti todunga itna bhi nalayak nahi hoon main. Zaroorat padi to bhookhe pet so jaoonga pad..

Naina- Sameer, abhi bhi nahi samajh paaye na tum kuch bhi? Aakhir kab samjhoge ki shaadi ke bandhan main meri ya tumhari ke liye koi jagah nahi hai.. Jo kuch hai sirf humara.. agar tumhari baat manni ho to main "tumhare" ghar mein kyu reh rahi hoon? Dhakke maarkar nikale Jane pad bhi wapas aayi hoon main yahaan.. (and runs upstairs)

Sameer ( realises what he has said and says to himself) - Abhi abhi to biwi ghar louti thi.. yeh nahi ki pyaar se rakhega.. nahi phir use naraaz kar diya..

He ponders for a while and thinks.. ' Naina mujhe pata hai Maine jo ghaav diye tumhare woh ab bhi taaze hai.. I promise main poori koshish karoonga sab kuch theek karne ka'

Afternoon at Krishna Koustabhi

Samaina are having lunch in silence when the phone rings.

Sameer- Hello..

Sanjay- Sameer , theek 3 baje court mein milo, mujhe kuch hints mile hai case ke baare mein. There's no point in delaying filing the case.

Sameer- Fine, I'll meet you at sharp 3 'o' clock.

Sameer turns to hug Naina tightly and says- Naina aaj hi Sanjay me case file karne ke liye bulaya hai.. Jo bhi khoya tha humne sab mil jayega wapas.

Naina moves away from the hug and says- Sameer case file to ho jaayegi.. pad kab tak chalegi yeh nahi pata.. Maine dekha hai tauji ko cases ladte hue.. din, maheene, aur kabhi kabhi saalon lag jaate hai case khatam hone mein..

Sameer is shocked seeing the pessimistic views of the strong, always positive Naina he always knew.

Naina soon realises that now is not the time to fall weak to her insecurities. She says, ' Pad jaisa bhi hoga, hum kabhi haar nahi maanenge'

Sameer- (holds her by her shoulders and says) ' main tumhe kabhi haar nahi maanne doonga'

Ahmedabad Court, 3 'o' clock

Sanjay- Sameer, sirf case file karna enough nahi hoga.. humein aur strategies apnani hongi.

Sameer-Jaise?

Sanjay- Kamlesh Maheshwari jitne bhi dealers se order lete hai ya dete hai.. humein sabki is case ke baare meim inform karna hoga. Once dealers are convinced that Kamlesh isn't the owner, har order har delievery pad they'll demand your signature, not his, is tarah hum unpad pressure create Kar paayenge..

Sameer- Haan, Maine to iske baare meim socha bhi nahi.. munshiji hai , unse to mujhe purane dealers ki bhi list mil jaayegi.

Sanjay- Excellent, phir to humein witnesses bhi mil jayengi.. I'd advise you that you visit Every dealer with a copy of original ownership documents. And make sure this convincing stuff goes on secretly.

Sameer- Alright, thank you Sanjay .

Sameer vo- Aaj se pehle jab bhi aisi strategies lagayi thi maine.. usmeim kuch khone ka nahi tha.. pad is baar bohut kuch daav pad laga tha.. shayad mai haar bhi maan jaata.. pad Naina har pal mere saath khadi rahi dhaal ki tarah. uski topper dimaag aur mere jugadupan se humne kaise sabkuch kiya aaj bhi sochta hoon to aascharya hota hai..

For the next 1 week, Sameer approaches each dealer separately and tries convincing them . Naina wanted to help, but it was important for her to keep working to provide for their finances. Finally, the day of the hearing arrives.

On the day of the hearing,

Before leaving the house,

Samaina look up at Nanu's photo and pray in front of him..

Sameer - Kaash Nanu aaj humare saath hote to yeh sab humein jhelna nahi padta.

Naina- Nanu abhi bhi humare saath hi hai, tumhare andar ka business strategies ka hunar, sacchai, yeh sab Nanaji ke ashirwaad se hi to hai. Aur dekhna, yeh case jab bhi khatam hona ho hoga, pad humare hak humein zaroor milenge.

Sameer hugs her and kisses her head, reassuring himself as well as her to stay strong enough to endure the storm awaiting them.

Chachaji and chachiji walk in .

Samaina touch their feet and greet them.

Chachiji- Beta aaj tumlog ke liye khaas Mata raani ka prasaad laayi hoon. Bhagwan jhoot na bulaye mujhe poora yakeen hai ki case to tumlog hi jeetoge.

Chachaji- Waise Yakeen nahi aa raha ki jis Sanjay ko school ke dinon mein humare taraf se itni daant mili thi woh kabhi itna madad karega.. Chalo ab bohut late ho raha hai nikalte hai.

Sameer thinks for a while and says- Chachaji, mujhe maaf kijiyega , pad main nahi chahti ki aap humare saath chale.

Naina- Pad kyu? Humare saath bade rahenge to acche hi hoga na.

Sameer- Nahi isliye nahi. Mamaji mamiji bhi wahin honge, aur main nahi chaahta ki woh aapki beizzati kare. Humare saath kuch bhi kare, hum bardaasth kar lenge, pad aapke saath nahi..

Chachiji- Arey beta koi baat nahi. Humein pata hai kya ho sakta hai. Pad tumlog to Bache ho mere. Ek maa apne bacchon ke liye sabkuch sehen karti hai.

Naina- Nahi, chachaji chachiji, Sameer theek keh raha hai. Aur sirf beizzati hi nahi. Kya pata mamaji aapko bhi is case mein ghaseet le aaye, ya aapko target karle, phir humare liye sabkuch aur mushkil ho jayega.

Chachaji- Theek hai beta. Pad loutkar batana zaroor ki kaisa raha sab. Jeete raho.

Samaina leave.

Ahmedabad Court

Samaina enters the court only to find Mamaji sitting comfortably who smirks at Samaina and twists his moustache, his eyes confident of a straight victory.

As they sit on the benches, Mamaji approaches them and says,

"Kya Sonu beti ghar ki baat ghar mein hi mit jaaye to hi accha hota nahi.. yeh khwamokhwa court ka chakkar lagakar accha nahi kiya.. jeet to sach ki hi hogi.. hai ni haini haini. "

Mamiji walks over and says, "Sameer beta tumhe hazar baar samjhaya tha ghar mat chodo. Ab bhugto. By God, pata nahi yeh dono bacche Kya sochkar court mein aa gaye.. inko lagta yeh court case jeetenge." And laughs in a sarcastic manner.

Sameer tries to give back but Naina holds him back and says, "Sameer, inki baaton pad dhyaan mat do, yaad rakhna ki tum Apne Nanu Jaiprakash Maheshwari ke natin ho jo apni saadgi, sacchayi aur acche vyavhar se jeet haasil karte the.woh kabhi apna aapa nahi khote the."

The court proceedings begin with Sanjay giving a detailed outline of the case and lists down the accusations against Kamlesh Maheshwari. He also reads out the will of Nanu in the court . He then presents an old dealer Mr. Adwait Patel as a witness who testifies against Kamlesh.

Adwait- My company has had major dealings with Mr. jaiprakash Maheshwari. He was an old friend of mine. In fact the will which he had signed in which he stated that Sameer will take over the Maheshwari industries was signed in presence of me and Late Advocate Mr. Harish Saxena who passed away last year .

Sanjay asks him- Mr. Adwait Patel, So do you still deal with Maheshwari industries.

Adwait- No. When Mr. Kamlesh Maheshwari took over the responsibility as a caretaker, he cancelled all deals with my company.

Sanjay states that the copy of the will is the original copy and the copy with Kamlesh is a counterfeit one.

' Objection, My Lord' ,says Mr. Dinesh Jain, the lawyer on behalf of Kamlesh Maheshwari.

Dinesh - According to existing laws, the documents that have the latest dates are the ones that will be held valid. The one mentioned by my respected colleague Mr. Sanjay Tebriwal states the date to be 5th January, 1989. While the one that my client has was signed on 27th March, 1990. You may see the will. ( He presents the documents to the judge)

Judge- Do you have anything to say about this Mr. Tebriwal.

Sanjay- I request for some time to look further into the case.

Sameer and Naina both tense up and hold each other's hands tightly .

Dinesh- My Lord, it's a clear open and shut case. Mr. Tebriwal has been in no way able to prove that my client has presented false documents. Giving time might lead to tampering of evidences and..

Sanjay- Objection, My Lord. The court functions based on proofs not on doubts or wild imaginations of any individual. And if it's so, Sir can any reasoning justify why Mr. Jaiprakash decided to handover his entire property, company to Mr. Kamlesh Maheshwari, his nephew , and not his own grandson Sameer Maheshwari, or for that matter his own daughter, Mrs. Vishakha Somani.

Dinesh- Mr. Sameer Maheshwari was always known as an impulsive person who is incapable of handling such huge properties. So it was obvious..

Naina is shocked and angry but Sameer calms her down. Sameer whispers to her- Naina, jaane do.. mujhe kahi na kahi pata tha ki Mamaji mere baare mein yeh sab court mein bulwayenge. Tum chinta mat karo..

Sanjay- There again goes assumptions without any proofs. You cannot put such baseless allegations on my client.

The judge admonishes them and calls for maintainence of order in the court.

The judge- In view of statements given by the lawyers, the witnesses and documents provided, 2 weeks time is granted on request of Mr. Sanjay Tebriwal. The court is hereby adjourned.

Sameer and Naina both are disappointed at the Court's proceedings. Naina( in tears whispers) - Sameer, hum haar Gaye . Ab 2 weeks mein aisa kya hi kar lenge hum, Kya kar lega Sanjay.

Sanjay- Bohut kuch. From the beginning I knew that humari case weak hai. Agar Sameer ke Nanaji ke lawyer ka intekaal na hua hota pichle saal to yeh case humare liye aaj hi khatam ho jaati. Main ek lawyer hoon and I know how crooked Kamlesh Maheshwari's ways are. Pad jab ghee seedhe ungli se na nikle na to tedhi ungli se nikalna padta hai.

Sameer- Matlab? Agar pata tha tumhe ki court mein case file karne se koi faayda nahi hoga to file kiya hi kyu. Aur woh jo chakkar lagana pada saare dealers ka, woh sab bhi bekar gaya.

Sanjay- Faayda hai. Kaisa faayda yeh tum aur Kamlesh bohut jald samjhenge. Filhal humein aur kaam karna hoga.

Sameer- Ab aur kuch karne ke liye bacha bhi hai?

Sameer sits down holding his head in his hands.

Naina tries to comfort Sameer and says- Ek baar sun to lo kya keh raha hai Sanjay.

She turns to Sanjay and says- Tum bolo.

Sanjay- Humein Sameer ke Nanaji ke ghar ke original documents ka pata lagana hoga. He asks them to approach Vishakha while he finds out from the Municipal Corporation about house registration, etc.

Naina- Thanks a lot Sanjay for helping us so much.

Sameer, chale?

As they're about to leave Mama-mamiji approaches them. But Samaina ignore them and leave on their bike.

While on their way to home, Naina pokes Sameer on his shoulder.

Sameer(irritated) - Kya hai?

Naina makes an innocent baby face and says- Sameer, chalo na law garden mein jakar thodi chaat aur icecream khAkar aate hai.. kitne dinon se nahi khayi..

Sameer is about to reply harshly when he notices Naina's baby pout in the rear view mirror of his bike. By Now Naina has slipped closer to him and has slipped her arms around his shoulder and repeats- Le chalo na .

Sameer smiles at Naina's tactics and feels a bit better as he realises Naina has let go of her inhibitions to make him feel better. Since the she had returned to his house , she has been supporting him selflessly, doing everything that's needed, but this cute affectionate demands, she had stopped making them altogether. She had stopped exerting her right over him.

As his mind became clearer,Sameer said to himself in his mind- Life mein mushkilein , toofaan to aati jaati rahengi. Agar kuch humesha ke liye hai to sirf Meri Naina. Aur uske liye itna to kar hi sakta hoon. Agar woh apne gam, apna dard, sabkuch chupakar mera saath de sakti hai to main bhi apni tensions ko kuch der ke liye side mein rakh hi sakta hoon.

Sameer- okay, chalte hai.

Naina vo- Usdin humari halat ajeeb si thi. Jab mushkilon ne pehla thappad lagaya humein. Hum use accept karne ke bajaaye use ignore karne ki koshish kar rahe the . Lekin aakhir kab tak?

Finally I managed to write this update. There are many factual errors here as I have zero idea about court proceedings other than that what I have seen in different shows. That 'recent date' point was used in ek duje ke vaaste show, I used that idea. The rest is all made up, and I have absolutely no clue whether those points are even valid. So I apologise in advance for all of this. I don't intend to drag court proceedings as I know the way I write them they're plain boring😔, I could'nt even manage to re-read this part of the story 😂 All the best to those (if anyone at all ) who manage to read the entire part.
