DILL MILL GAYYE VALENTINE SPECIAL CONTEST" RULES AND REGULATIONS

"DILL MILL GAYYE VALENTINE SPECIAL CONTEST ("Contest") will be held on STAR ONE "Channel") as stated hereunder:

1. The Contest shall commence from January 29, 2008 at 9.00 AM and shall conclude on February 5, 2008 at 12.00 AM ("Period") on the Channel.

2. The Contest will be pertaining to two (2) characters i.e., Dr. Armaan and Dr. Riddhima ("Characters") acting in the program titled "Dill Mill Gayye" ("Program") telecast on the Channel. The promos of the Program will be displayed on the Channel featuring the Characters of the Program during the Period.

3. The viewers interested in participating in the Contest must log on to the website www.indya.com ("Website") and send in their entries giving their unique ideas of proposing either of the Characters of the Program on the Website itself.

4. All the entries received during the Period on the Website will be short listed by the Channel and/or Star India Pvt Ltd ("STAR India "). All the entries must be sent within the Period. Any entry sent by the viewers beyond the Period will not be considered and will be null and void.

5. All the entries should state all the required information, which have been asked from them.

6. STAR India shall select six (6) finalists ("Finalists") among the contestants out of which there will be three (3) girls and three (3) boys, who have given complete entries during the Period and as deemed fit by STAR India and/or the Channel.

7. STAR India and/or the Channel reserve the right to decide the Finalist(s) of the Contest.

8. The Finalist(s) will get a chance to propose their favorite Character(s) in the valentine special episode ("Valentine Special Episode") of the Program which will be telecast on February 16, 2008 at 8.00 PM to 9.00 PM on the Channel.

9. The set of the Program is located in Mumbai. Therefore, in the event the contestant(s) is selected as the Finalist of the Contest and is residing outside Mumbai, the Finalists would have to travel to Mumbai.

10. STAR India and/or the Channel(s) shall have the sole right to decide the dates to visit the set of the Program stated in rule 9 herein above.

11. In the event, the Finalists cannot travel and visit the set of the Program on the date on which STAR India and/or the Channel has decided for the performance as stated in rule 10 herein above, STAR India shall be entitled to forfeit the Prize and/or announce somebody else as the Finalist of the Contest.

12. It shall be the sole responsibility of such Finalist(s) to travel to Mumbai and reach the set of the Program at its own costs and expenses to participate in the Valentine Special Episode of the Program on the Channel. STAR India and/or the Channel shall not be responsible in any manner whatsoever for the travel and stay etc expenses incurred by the Finalist(s) in relation to the Contest.

13. The finalists who will propose the Characters in the Valentine Special Episode in the most unique way in view of the Characters will be the winner of the Contest.

14. There will be two (2) winners i.e., one (1) girl and one (1) boy ("Winners") among the Finalists and the remaining four (4) finalists will win consolation prizes ("Consolation Prize Winners).

15. The Winners will get a chance to go on an exclusive date with the Characters sponsored by STAR India ("Prize").

16. The Consolation Prize Winners will get Dill Mill Gayye merchandise as consolation prizes ("Consolation Prize").

17. STAR India and/or the Channel reserves the right to at any time to withdraw the Contest without giving any prior notice thereof to the contestants or change the timings of telecast of the Program on the Channel.

18. Any questions in relation to the Prize and/or Consolation Prize should be forwarded directly to STAR India and shall be directly settled by STAR India.

19. The Winners and/or the Consolation Prize Winners and/or the Finalist(s) shall be informed/contacted by the STAR India.

20. The Winner and/or the Consolation Prize Winner(s) shall not raise any dispute with regard to the Prize and/or in any manner whatsoever in connection to the Prize and/or the Consolation Prize.

General Rules

1. The contestants should be citizens of India, residing in India and above 18 years of age to qualify for the Contest.

2. The contestants should not have criminal conviction.

3. Proof of age is a must for the contestant and must be submitted to the Channel and/or STAR India (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

4. STAR India reserves all rights to make amendments to the existing rules without prior notice.

5. Non-conformance by any contestant and/or the Winner and/or the Consolation Prize Winner and/or the Finalist(s) of the rules of the Contest will disqualify them from participation or winnings, immediately, as the case may be.

6. STAR India may in its sole discretion exclude a contestant(s) from participation in the Contest which may include without limitation (i) circumstances which, in STAR India's view, renders the contestant(s) unfit to participate therein; (ii) inability to produce documentation required by STAR India and/or the Channel in the rules and/or at any given point of the time.

7. STAR India and/or the Channel reserves the right to cancel the entry of the contestant(s) for any reason whatsoever. For avoidance of doubt, the disqualified contestant(s) agrees that all the intellectual property rights in and to the Contest shall continue to vest with STAR India for worldwide and in perpetuity, without any consideration payable to the disqualified contestant(s).

8. STAR India and/or the Channel may refuse the contestant(s) from participating in the Contest in the event of his fraud, dishonesty or non-entitlement to participate in the Contest under this rules and regulations.

9. The Finalists and/or the Winners and/or the Consolation Prize Winner(s) of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with STAR India and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Winner. Further, the Finalists, Winner and/or the Consolation Prize Winner(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever.

10. STAR India and/or the Channel shall have irrevocably rights to the Contest and/or participation of the contestant(s) including all the activities of the contestant(s) during their participation in the Contest including but not limited to the Finalist(s) visit to the sets etc., being filmed and/or recorded and/or broadcast on the Channel or any other channel that STAR India and/or any other channel, which STAR India and/or the Channel may deem fit.

Further, the contestant(s) shall permit STAR India and/or Channel to use of the contestant(s)'s name, likeness and private life to be included in the subject matter of the Contest and any related publicity, advertising, magazine material and/or otherwise. Further, STAR India and/or Channel shall have full right to the footage of any nature in relation to this Contest and all such rights shall at all times vest with STAR India, including but not limited to all intellectual property rights, copyrights and any other rights, in any and all media, worldwide and in perpetuity. It can be arranged, re-arranged, added to other material without any payments to the Finalist(s) and/or the Winners and/or Consolation Prize Winners, as the case may be.

11. Notwithstanding a contestant(s) participation in the Contest there is no obligation on the part of STAR India and/or the Channel to broadcast the Contest in which he has taken part, or any or all of his contribution is recorded by STAR India and/or the Channel.

12. The Consolation Prize Winner(s) shall be responsible to collect the Prize from STAR India. The contestant(s) agree that the Prize cannot be exchanged with other items and/or exchanged for cash equivalent. The contestant(s) further agree that he/she shall not dispute the value of the Prize so offered to him upon him winning the Contest. If the Winner and/or the Consolation Prize Winner(s) refuses to accept the Prize and/or the Consolation Prize, offered, as the case may be, STAR India shall be released from all obligations towards the Winner and/or the Consolation Prize Winner(s) in connection to the Prize and/or the Consolation Prize won by the Winner and/or the Consolation Prize Winner(s) as the case may be.

13. Neither STAR India nor its employees nor its group company(ies) have given a guarantee or warranty etc. regarding the quality, quantity etc. of the Prize. Neither STAR India nor its employees nor its group company(ies) shall be responsible in connection Prize and any dispute in connection to the Prize and/or the Consolation Prize shall be settled between the Winner and/or the Consolation Prize Winner(s) and STAR India directly.

14. The contestant(s) of the Contest agrees that he/she shall hold harmless STAR India and/or the Channel, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Contest and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the STAR India to claim any damages or reliefs.

15. The Winner and/or the Consolation Prize Winner(s) of the Contest agrees that he/she shall hold harmless STAR India and/or the Channel, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her in any manner, whatsoever, in connection with the Prize and/or the Consolation Prize, as the case may be, and that the Winner and/or the Consolation Prize Winner(s) shall also not file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against STAR India to claim any damages or reliefs or otherwise.

16. The Winner and/or the Consolation Prize Winner(s) agrees that if due to any reason, whatsoever, STAR India, the Prize and/or the Consolation Prize and/or anything in connection to and/or the enjoyment of the Prize and/or the Consolation prize, STAR India shall not be responsible for the same.

17. The STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the winner in any manner whatsoever, including but not limited to the Contest and/or Prize and/or the Consolation Prize.

18. Employees of the STAR India, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to enter the Contest.

19. The contestant(s) including the Consolation Prize Winner(s) shall abide to the laws of India including Income Tax Act, 1961. STAR India and/or the Channel will not be liable for non-compliance of any laws by the Consolation Prize Winner in India and the Consolation Prize Winner shall indemnify and hold harmless the Channel and/or STAR India in relation thereto.

20. Neither STAR India nor the Channel shall be responsible to pay for any taxes, custom duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the Prize and the same shall be solely borne by the Consolation Prize Winner(s). A copy of the receipt (challan) confirming the payment of such taxes, charges, license fees and/or levies thereto shall be furnished by the Consolation Prize Winner(s) to STAR India.

21. Participation of the contestant in the Contest shall be construed that the contestant has waived his right to dispute any decision(s) made by STAR India in connection to the Contest and that he agrees to all the decision(s) made by STAR India and that all the decision shall be final and binding upon him.

22. The participation of the contestant(s) in the Contest shall mean that the contestant(s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Contest.

23. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the contestant(s) who has raised the dispute.
