Reporters proved to be legal in the court of law - Part IX

Hi Guys,
I am presenting to you the last part of my analysis of Reporters from legal point of view. Needless to say that the last episodes covered one single case that is of Sudhir Kashyap's murder, however, since the case was the most important one, it had various clause in it. That is the reason, I segregated it into three important parts which are actually important factors from legal point of view...
Lets see what they are :-

Shreya being bipolar: While, in the serial Shreya, being bipolar, gave a lot of hope not only to the lead pair KaYa and also some of the viewers that now Shreya can be easily thrown out of KKN on the basis of her mental illness, most of us did not agree mentally illness being made a clause of sacking a person and how much we sighed with relief when Shreya was being thrown out of KKN for more valid reasons. Shreya's sacking out of KKN was also not possible from the legal point of view. In Indian laws, Mental illness has been recognized as one of the disabilities under Section 2 (i) of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. According to the report of the Committee constituted by the Department of Health, Government of India for evaluation and assessment of mental illness and procedure for certification, there are certain aspects that have to be considered for termination of a mentally sick employee. These conditions are : does the person, in question go to work regularly? Does he like his job and coping well with it? Can he be relied on financially? Patient goes to work regularly and his output and quality of work performance are within acceptable levels for the job. If there is a noticeable decline in patient's ability to work, to cope with it and meet the demands of work. May threaten to quit. if there is declining work performance, frequent absences, lack of concern about all this.

The most severe symptom and a valid reason is marked decline in work performance, disruptive at work, unwilling to adhere to disciplines of work. Threat of losing his job. Or has been largely absent from work, termination imminent.

In all the above symptoms, Shreya didn't show even one symptom which means that she was fit to continue the job from the legal point of view.

Sudhir Kashyap Case : The SK case, with all the bloopers and going off the track, was the most important case of Reportes, since, it formed the essence of KaYa relationship. However, this case was also important from legal point of view since, this single case covered many acts such as Section 304- II of the IPC for unintentional murder (death of 50 children), the act of fraud in Section 23 under The Indian Contract Act 1872 (providing wrong medicines to public), Culpable Homicide under Section 299 of IPC and murder under Section 300 of IPC (Murder of SK), Attempt to murder under Section 307 of IPC (Ananya) and participation in murder/ attempt to murder under Section 34 of Common Intention and Common Object Under IPC 1860 (this section is applicable for Shreya). All these acts and sections are duly covered in this case. This case told us that the law system of this system is indeed strong however, RG telling Manav that he had bought everyone from Judges to witness, told us about the ironical conditions of the prevalent law machinery of this country. The case of SK also is a beautiful example of the phrase "Justice Delayed is Justice Denied"

Murder of Ronnie : Though Ronnie's murder was a part of SK case but his murder was equally important for two important reasons. Firstly, Ronnie was one of the sweetest characters of the entire cast. The only characters who didn't deteriorate in any manner. Hence, his murder not only shocked the viewers but it also invited the wrath of the passionate viewers for the CVs. Secondly, this murder was also important from legal point of view since, in this case only, Shreya could be arrested for the offence of participation in murder/ attempt to murder under Section 34 of Common Intention and Common Object Under IPC 1860, as mentioned earlier. Thus, it can be said that though Ronnie's murder was one of the worst incidents of the entire serial, without his murder, Shreya couldn't have been shown in jail.

Hence, it can be said, at the end, that not only journalism. Reporters indeed proved to be LEGAL right from Day One, giving ample respect to the law system of India.

Hey I just gave an idea. The hard work and effort that was required to make these posts was entirely yours. So full credit to you, dear. Thank you so much for sharing this perspective. I gained must from reading these posts which were quite informative. In addition to that, thanks so much for giving so much of credence to my idea and taking it forward.

I was fine with the way they handled Shreya's bi-ploar case. Like you said, considering the big picture, it was not necessary to disclose about her mental illness to the whole world. But, at the time they revealed it, Kabir and Khalid didn't have the necessary shares go get her out of KKN. They got those shares a little later, and even that was by mere coincidence.

Revealing her mental illness was to humiliate her. Kabir did gave her a long rope to mend her ways. Shreya refused to treat him with the same amount of respect he was giving her, and instead went ahead with her plan to cause trauma to him and Ananya. So, the way I look at it, she humiliated Kabir and Tarini. Kabir humiliated her. Simple as that. That is how life works. What you do unto others, others can do the same unto you!

You summed it pretty well for SKs case. Justice delayed is justice denied. Considering how our glorified legal system works, this is a way of life for us.

Ronnie's murder, in my opinion, was THE single most unwanted thing in the serial. If the intention was to show Shreya's arrest, she could have been punished for attempted murder. They need not have shown an actual murder. If the intention was to show KKNs involvement, instead of Kabir and Ananya fighting a personal battle to get justice for SK, even then this murder was not necessary. They already showed RGs involvement, and he is one of the main sponsors. So, KKN and its entire staff could have been united to save their channels reputation. Either ways you look at it, this was a classic case of the an idea gone wrong. Like you said, CVs bore the brunt of viewers (including me) wrath, so fair enough. Nothing else to add.

As this is the last part of the series, not sure what else we can talk about here. 😊 Need to think of something else, I guess, till season 2 happens...

As they say starting problem is a big problem so same goes with me... I must say that initiations are important and thats what you did. And what I shared here, was also a learning experience for me since, few times, even I had to look for my notes and old law books to understand a particular case. So thanks a lot dear for brushing up my knowledge.

Yes, Kabir and Khalid got more shares out of luck, it seemed they didnt deliberately tried for it. Rather, Kabir concentrated much on proving that Shreya is mentally ill which slightly didn't go well for me. I was not okay because, as it is Indian society is not very much positive with mentally sick people. Many times, the cases worsen due to negligence and rude treatment of the society and people around, which is a saddening thing to note. Hence, in such circumstances, at least I did not expect a serial like Reporters adopting more or less the same attitude. Moreover, Shreya being shown as a Bipolar didn't have any sense since, unfortunately or fortunately, she did not show even one sign of the said illness.
However, I agree with you that what Kabir did was simply a revenge that he took from Shreya, so at the end of the day, can't really blame him for that!!!

Yes, Ronnie's murder was indeed unwanted. In fact, I was also not convinced with it and you know it pretty well. However, after giving a lot of thought to it, I could find only this reason which I stated in the post for this murder. As participation in Attempt to murder is slightly a less heinous crime than participation in murder... so may be, that was the reason, else, even after a lot of pondering, I couldn't find the reason for this brutal act.
As this is the last part of the series, not sure what else we can talk about here. 😊 Need to think of something else, I guess, till season 2 happens...

We seem to be thinking more about Ronnie's death than the CVs ever did.. We are trying hard to find a justification for it.

Had CVs put in even a fraction of this thought process, their justification would have been apparent in the serial..
