In India, YES it is. And this is known as Article 377 of the IPC(Indian Penal Code) which states that 'acts against the order of nature'(eg. homosexuality) are considered as criminal acts.😡
However, the Delhi high court passed a ruling in 2009 saying that this law is archaic and unconstitutional in the case of consenting adults. So it wasn't implemented all that much..
Then in 2013, the Supreme court overturned this ruling and decided to uphold this law..😕
This decision was heavily criticized by both the media and the general public. So after a lot of protests, demonstrations and opposition, the Supreme court finally declared that amending and repealing the law should be the Parliament's responsibility and not the judiciary, conveniently passing the buck and absolving themselves of all controversy..😆
And that is the current state of affairs as it stands..😭
With the Indian government being what it is with regard to productivity and efficiency, frankly I think it's going to take a while before this issue is handled with the importance, sensitivity and respect that it deserves..
To me, the height of irony is that even a tiny country like Nepal legalized homosexuality in 2007 and same sex marriages in 2008.. So much for modern India!😈
