What's sultan legal standing???

Hi.

Sultan's story is very interesting. Here are few angles that I am curious to know about:

1) MK was going on donating Vicky donor style. Meera and her colleague found it out and as MK was rich his offspring is pooping up now. BTW what happens in case kids are created through donation process. What are such kids rights on biological parents or their ancestral property if without will? What did ND Tiwari kid achieve through paternity suite?
2) While kangan story makes it look genuine but it's not proof enough to state that MK loved Meera. Even if he is genuine son of M&M, I don't think he or Meera are legally entitled for anything for betrayal. isn't it?
3) MK was told to be a casanova. What happens to biological kids of such person outside marriage?

It will be good if someone could clarify.

Found some answers in the article (

Marriage, be it void or voidable, between a man and woman was a pre-condition to bestow right on their progeny, even if illegitimate in the eyes of society, to lay claim over the father's property.

This means, a child born out of a legally invalid marriage could claim right to inherit his father's property alone and not lay inheritance right over ancestral property, which legitimate children could.

What happens to children born from live-in relationships, where no marriage has taken place? The Supreme Court had presumed a man and woman to be married despite them only having a live-in relationship if they lived for a very long time under one roof and were known in society as husband and wife.

In S PS Balasubramanyam vs Sruttayan [AIR 1992 SC 756], the SC had said, "If a man and woman are living under the same roof and cohabiting for a number of years, there will be presumption under Section 114 of the Evidence Act, that they live as husband and wife and the children born to them will not be illegitimate."

The crucial pre-conditions for a child born from live-in relationship to be not treated as illegitimate are that the parents must have lived under one roof and co-habited for a considerably long time for society to recognize them as husband and wife. It must not be a "walk in and walk out" relationship, as the court pointed out in its 2010 judgment in Madan Mohan Singh vs Rajni Kant.

forget ancestral property, MK had none, if he had, he wouldn't have to marry a rich girl Radha..RK's property is his own and nobody except his own children , wife or mother can claim a right on it...whatever properties or assets were built by him, he must be the ONLY legal owner..

chalo, shadi ki bhi chodo,what proof does Rashid has that Sultan is MK & Meera's son?

its the fact that the money rk has is made from his own sweat n blood, his father left them without anything as its radhaji money which got him restarted in the film industry Sultan only has claim on mohans property which was nothing as he lost it so he has no claim on rk or radhajis property

Well it would not be that simple. Depends on who build RK's studio and posh bungalow. I don't think it's been clarified as yet that RK build all that on his own. Also MK was shown to be highly successful casanova and only latter he lost money as some of his movies didn't do well. So effectively it may be mean that the property are in his name but he might have taken some loan which were probably cleared by RK when he became successful. It's easy to check whose name appear on legal papers but very difficult to prove whose blood, sweat and money was used to pay off the bills.

It's easy to prove whose son Sultan is by doing a DNA test. RK and Sultan DNA will be 50% match (MK side). Only difficult part to prove is that Sultan's mom got married to MK and Sultan was not born through IVF etc. M&M marriage has been briefly alluded to by missing Kangan and in Rashid's testimony. However I think it's very difficult to prove a marriage without proper witness.

Proof are tumbling left right and center. Radha also knew everything. Now even news papers are saying Sultan is legitimate son. So does anyone thinks CVs will play some honky ponky in this story...

DNA tests are pretty easy and cheap to solve these kind of puzzles. We are not living in 20 century.
