No they are not legally divorced so they are still married. The days are changing now so whether you wear mangalsutra or no it does not make any difference but ya after divorce it should not be worn.

Even as per Hindu rituals they cannot be called married as they never performed the rituals in a correct way. For getting married 7 pheras are essential and he didn't do that and neither did he go for registering the marriage, so it was more of emotional bonding than marriage.
