Anyone know law terms...Prenuptial means divorce...is it?

AS I know...Prenuptial means no property shares after divorce...Or they will divorce because husband wife live separately without any touch...7 years...kind of untraceable...then they divorce automatically...

Please help to know about both teams...if anyone know about law .

I don't think pren up means divorce.

Its jus an agreement in which wife willhave no share in property in case of divorse.

True that meant they didn't divorce only separated like many couples done in our Indian society...but 7 years leap means automatically divorce without any legal work...untraceable or untouched in communication couple divorced automatically if they live separately 7 years...is this purpose of 7 years...as we all were saying... why 7 years..makers planned 7 years because of this...is it???

Pre nuptial means before your nuptials...before your marriage. So what Sona signed is not valid because it is after the marriage.
It can mean two things the makers do not know law
Or they will use this as a loop hole for Dev to fight for custody of his child.
Because this agreement states no child support in case of separation and mother has sole rights and it would have been valid if Sona had signed it before marriage not after.
hope it clears some of yur doubts

https://www.quora.com/Is-separation-between-a-husband-and-wife-for-more-than-7-years-equivalent-to-legal-divorce-according-to-the-Indian-constitution. they will live as estranged couple acc to articles n staying away for 7 years or more they won't get divorced automatically as husband or wife need to file for divorce even if they are not in touch for 7 or more whatever years acc to the link I hv shared n lastly in tv show they can show anything

Prenup is a contract signed between a couple at the time of marriage safe guarding their rights as individuals in case of a divorce. The contents of such a contract depends solely on both parties involved.

Nothing happens automatically in case of law. Staying away for 7 years will not automatically give the couple divorce. It will only be a ground for divorce. The couple will still have to file for divorce and slug it out. The law will only state the grounds for divorce but unless either party does not file in the court, the court will not interfere.

I know quite a bit of Indian law, but I am still not a lawyer. In fact, I am raised abroad, but I love to read about legislations in different countries.
A prenup is an agreement between the future-spouses on what will happen if they were to get divorced. It is usually done to minimize conflict if and when divorce occurs.

The seven-year rule is a separate rule in Indian law. If two spouses do not have any contact between each other for seven years then divorce is easily granted when applied. However, the marriage does not dissolve automatically. (My aunt inquired about this when she wanted a divorce from my uncle, but she is too busy raising my cousins to apply. Her husband basically ditched her fifteen years ago, when her daughters were little children.)

pre nup is just an agreement and not divorce...it is null and void if not signed before marriage...here the papers had no worth ..it was only used to increase the drama between them and nothing more..
a marriage cannot dissolve automatically ...they will be estranged couple not divorced...for that they have to apply for divorce in a court and only then will they be legally divorced..they are still very much married legally..

Prenuptial is not divorce...it simply means property distribution btwn husband n wife if divorce hapens...sona did not need to sign since prenup is signed before marriage...but here since sona was angry n upset she signed it...the papers r predated so noone will be able to prove wen she has signed...
The way devakshi relationship has soured after this sign sona will never want to come back and so sona will be ready to sign divorce papers any day...moreover 7 yr separation automatically means divorce

Yeh doubt mujhey bhi thi!
But Shaheer ko pata hoga! He's a lawyer naah!😆😆

Anyway, Prenup is not divorce. It's just an agreement.

Which means they are still legally married.

Woh abhi bhi by Law pati patni hai!
