Actually, I think there's a provision in the law that allows a person to marry again if he/she has the consent of the first spouse. I think that's how Dharmender got married to Hema Malini.

In case of Prachi, she seems to have given her silent consent coz she can't do anything else! 🤢

There is no legal way in India that a Hindu can marry twice. Dharmendra and Hema Malini both converted to Islam to be able to marry legally. I think Hema Malini's muslim name is Ayesha Begum - it was brought up when she applied to be able to be part of the parliament...

I agree with gawker. What Pippa is saying was there prior to the 1955 Act which makes bigamy illegal. And yes Dharam-Hema converted to make their marriage valid.

Pippa, I had made a post on the validity of a marriage between Milsi and Ayesha around the time of their engagement. You may like to see this

Yes, I heard about the conversion too during the last elections but I thought Dharmendra had denied it as a rumour.
Opti, I've read ur post before. It's pretty comprehensive. Are u a lawyer by any chance? I remember that u'd written another detailed one ages ago on another matter of law....was it about divorce?

No Pippa, I am not. I have to admit that my knowledge on legal matters comes from the net and thus is secondary in nature. But I think personal laws are fairly clear on this matter. It is another thing that people resort to all sorts of underhanded tactics to evade it. In fact the doubt you had is something I had too and hence had checked the net.

I believe bigamy is a criminal offence but as per the criminal procedure code only the agrieved wife can file the case unlike other criminal offense where the State is the complainant. This gives the impression that if the first wife agrees to the second marriage, the marriage is legal which is not the case. All the guy can escape is punishment for bigamy but still all the legal rights will be with the first wife.

As far as I know bigamy, marrying twice in the eyes of the Indian Law is a criminal offence, and the second 'marriage' is deemed as void and null.

What conditions do persons wishing to marry have to fulfill before a proper Hindu marriage can be solemnized?

Neither bride nor groom should already be married or have a living husband or wife.

What options are open to a woman whose husband marries someone else while still married to her? Is that bigamy?

Yes, marrying again during the lifetime of one's wife or husband is known as bigamy. It is a criminal offence, punishable with imprisonment and fine. A bigamous marriage is void, a complete nullity (see answer to question No.5). If a woman has prima facie evidence that she is lawfully married to a man who is about to or has remarried, she can register a criminal complaint and the police are expected to stop him from getting remarried.
