Shiv is the real hero. If he isn't, then why does the EDT tune start playing every time he is shown? That's because he's the real hero.

Like someone mentioned earlier, hero isn't the one who gets the heroine but the one who the audience is able to connect with. For example, in Kal Ho Naa Ho, SRK doesn't get the girl but we all know he is the hero and not Saif. That's because audience was able to connect with SRK's character.

In this case audience have been able to conncect to Shiv's character and feel his pain.
