shiv is a ghost and if you are familiar with ghost movies its a very common thing to show ghosts invading personal space. its just to increase the spookiness and horror. he is a ghost neither he can sleep nor he can sexually assault her. also in all the ghost movies whether the ghost is good or bad they will scare the shit out of people at the start. its simply because movies are shown through the human eye and not through the ghost. they might be simply trying to communicate with the humans but since they are invisible it is scary for the humans.

Those 5 years are those years of Vyom's existence in her life so no the decision she makes is not valid..she lost her memory not vyom! He is suppose to fulfill the promises they made to each other not run away in opposite direction coz she is being rude.
