You know Hrithik was secretly enjoying all the attention and drama as long as it was hidden from the media. As soon as Kangana started releasing blind items and giving hints, he backed off because he cares too much for what his public reputation is. Even more so because he was getting divorced and he didn't want to come out looking like a cheater and scumbag like he actually was.

Backing off would mean staying quiet and laying low for the storm to blow away not slap a legal suit and bringing it out to public domain. It would be more of regaining/retaining his "image" that has been threatened by nameless rumors.

Hi public reputation took a very public thrashing when Barbara Mori happened.. He stayed put and did not react.. There is something more than meets the eye for such a strong reaction plus he initiated the law suit which implies he made his move after collating some strong evidence (all of) which has not been made public BTW...

The news broke out after the divorce not before..

As of now.. we can just watch the unraveling Tamasha and the changing dynamics in BW due to this act.
