In September 2002, Salman Khan ran over three pavement sleepers with his Toyota Landcruiser outside a bakery in Bandra. One person died while four others were injured. Khan was reportedly driving under the influence of alcohol and was accompanied by his cousin Kamaal Khan and his driver.

Doesn't this show you that he shouldn't have been free?

Neither i was there and neither you were there when he supposedly abused his ex, killed ppl, etc. I think he is guilty and you think he's innocent. Neither do i have solid proof he's guilty and i am pretty sure u have NO proof he's innocent!

i can give u more article from the same MEDIA which is praising Salman like anything......... so we can play this show - show some other time.......... untill u hve some COURT JUDGEMENT......

Why should I post that for I mean you already know they freed him which sorry to say was a BAD BAD DECISION he KILLED while DRINK DRIVING and he gets AWAY WITH IT!

Hit-and-run case: Prosecution for more serious charge against Salman Khan

The prosecution has told a local court saying Bollywood actor Salman Khan should be tried for more serious charge of 'culpable homicide not amounting to murder' in a hit-and-run case in 2002.

The Bombay high court at that time had dropped the charge of culpable homicide not amounting to murder against Khan and directed to proceed against him under the less serious charge of 'death due to negligence'.

Salman Khan's advocate Dipesh Mehta confirmed the development but said the prosecution has the privilege to move such an application at any stage of the trial.

The trial has been going on for the past six years and the prosecution has already examined 11 witnesses in the case, he said.

Salman Khan's Toyota Land Cruiser had rammed into a bakery in suburban Bandra killing one and injuring four persons who were sleeping on a pavement on September 28, 2002.

Khan was booked on the charge of culpable homicide not amounting to murder. However he had maintained that it was merely an accident and he did not have any intention to kill anyone.

The Bombay high court had held that Section 304 part II of the Indian Penal Code (culpable homicide not amounting to murder) was not applicable in the case and the actor be tried under 304 A of IPC (rash and negligent driving) and other relevant sections.

The prosecution in the 2002 rash driving case involving the Bollywood star Salman Khan has sought more stringent charges to be filed against the actor.

The case dates back to September 2002 when Salman's SUV rammed into a bakery in Mumbai and ran over the people sleeping by roadside, killing one and injuring four others. Salman was, and still is, booked for rash and negligent driving under Section 304 (A) of Indian Penal Code (IPC). If found guilty under this section, he faces a jail term of two years.

But now, the prosecution has filed an application in a local court in Mumbai to levy more stringent charges against Salman under Section 304 II of the IPC. Under this section, Salman could face the maximum sentence of 10 years in jail if found guilty.

Mind you, the charges against the actor have not yet been enhanced. Only an application has been filed. The matter will now be heard in court on March 22 when Salman's lawyer will file a reply.

Salman Khan files reply in hit-and-run case

Filing his reply before a local court here in the nine-year-old hit-and-run case, Bollywood actor Salman Khan today said that he cannot be charged under section 304-II of IPC (culpable homicide not amounting to murder).
The actor, in his reply filed before the Bandra metropolitan magistrate''s court, said that he cannot be charged under section 304-II of IPC (culpable homicide not amounting to murder) as it is mandatory for the prosecution to establish ''knowledge'' and ''intention'' on part of the accused in committing the crime.
The prosecution on Monday moved a petition before the Bandra magistrate's court against Salman seeking enhancement of the charges and permission to apply section 304-II of the Indian Penal Code, which will be tried in a sessions court.
The actor said in his reply that he neither had the knowledge nor the intention to kill any one referring to the incident of 2002.

One person was killed and four others sleeping on a pavement in Bandra were injured when Salman''s Toyota Land Cruiser allegedly rammed into a bakery in suburban Bandra on the night of September 28, 2002.

The actor had initially been booked under section 304 (Causing death by negligence) of IPC, however, Bombay High Court held that the section 304-II cannot be applied to Salman and he be tried under 304 A of IPC (rash and negligent driving) and other relevant sections.

A court of metropolitan magistrate had framed charges against Salman under sections 304 A of IPC (rash and negligent driving), 279 (rash driving), 337 (causing minor injuries), 338 (causing major injuries) and 427 (negligence) of the IPC.
The trial in the case started in 2005 and the prosecution has examined 11 witnesses. However, two witnesses -- Ravindra Patil, the police constable who was with the actor in the vehicle on the night of the incident, and Ramasray Pandey, an eye-witness, turned hostile in the course of the trial.

Actor Salman Khan on Thursday filed his reply to the prosecution's petition to book him for culpable homicide not amounting to murder in the 2002 hit-and-run case.

The reply, filed before the Bandra metropolitan magistrate court on March 14, came after the prosecution sought to enhance the charges levelled against the actor. The court is likely to hear the arguments on April 13.

In the affidavit, the actor stated that he could not be charged under Section 304-II of the Indian Penal Code (IPC) or culpable homicide not amounting to murder.

In a dramatic turn of events, the actor even denied that he was behind the wheel when his car rammed into a bakery in suburban Mumbai on the night of September 28, 2002.

The actor's lawyer said that he neither had the knowledge nor the intention to kill any one. The accident had resulted in the death of one person while four people were injured. The victims were sleeping on the pavement when the actor's Toyota Land Cruiser car ran over them.

"For charging someone for culpable homicide not amounting to murder, both knowledge and intention are required. Salman neither had the knowledge nor the intention to kill anyone," said Salman's lawyer Dipesh Mehta.

The actor had initially been charged with culpable homicide not amounting to murder but the charges were dropped after the intervention of the Bombay High Court.

Can you tell me how many accidents like those happen daily in INDIA ?? Can i hve the figures ?? Can u tell me how many ppl r held accountable for those acts ???

Give me break.......... none of u so called rocket scientist sitting over hve a single detail....... just u guys hve 1 accident in ur whole life that too reports printed by media ppl........
