No..not anybody...just now in the tehelka case, the police had to wait until the girl who was the victim of sexual harassment to file an FIR before they could take any action

That is why in the Tehelka case, there was voice raised by some organizations saying that the police should have taken Suo Moto action if they found evidence. But the police wanted to build a strong case against Tejpal and so they allowed the girl to take some time in order to build a water tight case against him.

On a serious note, I think everyone should have the right to stand up for themselves. If Andy wants to file a case against Kushal, I have no problem with it and I am not going to say anything against it. But, then Gauhar should also file a case against Andy for the lingerie incident. Kushal should also file the case against Tanisha. We can go on all day, but the end of the day it depends on the person in question. Personally, I support Sofia because Armaan was not sorry at all for his behavior.

EDIT: no intention to mock the system, but I feel a lot the charges can be applied to any of the housemates. I blame BB for all of it.

Well, I wish it was that simple. Not everyone can. First, the prima facie case is of outraging modesty of woman, which again is a woman specific law against a man. Hence, Tanisha cannot file a case against pratyusha. Needless to say, all others don't hold since they are not done by a man against a woman.

As far as kushal and andy is considered, a charge under 324 is hardly proceeded unless there is a serious hurt.

Now out of given sections.

354 will not hold up obviously, because there needs to be an overt physical act or action, which shows intent of unwanted intimacy, and the person has to act on it.

504 will not be applicable because it is mostly intended for religious or group acts. Police has registered it, but won't hold up in court of law since there was no possibility of arman mobilising a crowd against Sophia.

294 again I am not sure, specially due to censored visual. Unless arman has made some lewd signs and suggestions, it won't hold up.

The most serious charge is under 509 (which has been amended this year, due to delhi gangrape case) and is non-bailable, specially when it is coupled with 324.

Unless prima facie there is knowledge that there has been some serious conduct against a woman (again, a gender specific section). In addition, the minimum requirement for it is outraging modesty of woman, which by its very nature refers to sexual insults or acts.
