Shukla should be ineligible to win

Isn't it an unwritten rule of the house that someone who has been out of the house can't win? Otherwise Rishabh, Mahek should have won their seasons. Shukla left the house too for whatever reason it was but the truth is, he has not been in the house for the whole duration which should make him ineligible to win.
