Saanjh, too, tried to sweep an eye-witness under the rug because she knew him personally, hoping this would help her win the case.There is another option, although highly unlikely, still possible: It could've been that Ayaan had no intention to rape Maya but she just perceived it the wrong way and believed that was what was happening. In that case, she wouldn't be considered entirely wrong.
IMO he should be punished for sexual assault. Its hard to determine what was in his mind and what would have he done if Samay didn't reach on time. But him tearing her clothes and saying such dialogues, lying upon her and biting her neck will make any woman feel sexually offended.
