Sushil Kumar, a Delhi businessman, accused that he was deceived into investing in the Garam Dharam Dhaba franchise, leading to the Patiala House Court summoning Dharmendra and two others in a cheating case. Judicial Magistrate Yashdeep Chahal issued the summons in response to Sushil Kumar's allegations.
“The evidence on record prima facie indicates that the accused persons induced the complainant in furtherance of their common intent and the ingredients of offence of cheating are duly disclosed," the judge said in the summoning order passed on December 5, according to a report in ANI.
“Accordingly, let the accused persons at serial number 1 (Dharam Singh Deol), 2 and 3 be summoned for the commission of offences under section 420, 120B read with section 34 IPC. Let the accused persons at serial no. 2 and 3 be also summoned for the offence of criminal intimidation under section 506 of IPC," the court ordered.
The court has fixed the next hearing for February 20, 2025. It pointed out that during the summoning stage, only a prima facie case needs to be established, and a detailed review of the case’s merits is not required yet. Documents related to Garam Dharam Dhaba, including a letter of intent bearing its logo, indicate that the transaction involved the restaurant and was pursued by co-accused individuals on behalf of Dharam Singh Deol.
Sushil alleged that in April 2018, co-accused approached him for investing in a Garam Dharam Dhaba franchise in UP on behalf of Dharam. Offered 7% profit on a Rs 41 lakh investment and full support, Sushil was attracted by other branches' success. A letter of intent was signed in September 2018 for Rs 63 lakh. Despite paying Rs 17.70 lakh and buying land in Amroha, UP, the respondents didn't fulfill their promises. Sushil later claimed threats and financial loss, seeking repayment instead of the franchise.
