Hiding the Marital status - Immoral and Illegal

A person's legal marital status falls into one of the following categories:

1. Married

This category includes persons whose opposite- or same-sex spouse is living, unless the couple is separated or a divorce has been obtained. Also included are persons in civil unions.

2. Widowed

This category includes persons who have lost their legally-married spouse through death and have not remarried.

3. Separated

This category includes persons currently legally married but who are no longer living with their spouse and have not obtained a divorce.

4. Divorced

This category includes persons who have obtained a legal divorce and have not remarried.

5. Single

This category includes persons who have never married.

Intentionally hiding the correct marital status of an individual at the time of marriage is a CRIME and not just a mistake and could be considered as grounds for legal action.

However much we may empathize with the Senior Dubeys (myself included) because of their kind heartedness, forward thinking attitude and love for Aarti, they are still Wrong. And however much we might hate the convoluted logic of the senior Scindias about wanting a Widow and not a divorcee, and their narrow mindedness and their manipulative nature they are legally right. Because right at the first meeting itself the Scindias have very clearly stated the fact that they are not interested in a Divorcee but wont mind a Widow.

So intentionally hiding the correct marital status of the girl, even if it is for all the correct reasons, is still legally and morally wrong.

Oh is it that serious am not aware of law i thought if she is legally divorced and hiding this info may not be a crime or may not affect but after reading your info now i come to know that it is that serious hope the CVs shouldn't follow legal flaws and show us some thing real and legal. šŸ˜•

She is divorced so marrying again is not a problem.

But, yes hiding this from Yash's family is wrong as in the first meeting itself they told that they are not interested in a divorcee.

Lts see how these things unfold in the future

hmmm...not sure that hiding the fact of divorce is criminally liable...any lawyers on this forum?

I can imagine it being valid grounds for divorce though.

But I really feel quite strongly that this truth should never have been hidden.
Not on legal grounds, but on moral grounds.

A new relationship, and one that is as precarious as Aarti and Yash's, can never be built on a lie.

@narangi_77: Completely agree! I don't think that there is a legal issue with marrying off a divorcee by passing her as a widow, but it is morally wrong at every level. And it can definitely build a strong case for a divorce between Yash & Aarti when the truth finally comes out because the whole marriage was built on a big fat lie. It's not like the Dubey's hid that information about Aarti's past without knowing the Scindia's stand on divorcees vs. widowed, they made the conscious decision to lie after Gayatri specifically told them that they will accept a widow but not a divorcee...had she not said that so firmly this wouldn't be as big of a deal, but now when everything is going to be revealed Aarti is going to find herself in the biggest mess of her life!

Aarti and Yash are already so hesitant in this second marriage thing, and to start a relationship that is already so shaky and unbalanced on the grounds of a lie, that's just wrong from every angle! Because no matter how much the Dubey's try to convince themselves that this lie will never come out, the truth always has a way of catching up to you, and this time Aarti will have to pay dearly for their mistake. And to make matters worse, I am sure this reveal is going to happen just when Yash & Aarti start getting rid of their inhibitions towards each other, and will come as a huge jhatka to both of them!

Yes, it's a very poor and ill-considered decision, based on a logic that quite escapes me. Surely they don't want Aarti to be married at any cost? After the trauma she's been through, wouldn't they want an open and above-board marriage for her? Why would they put her in such a terrible position? It makes no sense to me.

Narrative-wise: Okay, if the Scindias were absolutely adamant about not having a divorcee...they hid the truth and the engagement has happened. Now, after the fact that Yash and Aarti and the kids have all met...surely they can reveal the truth and let Yash and Aarti make the decision.

I for one can see yash saying something like "the children have accepted her and so she's the one I marry"...there are so many narrative ways out of this.

Oooh we talked about this in law class in gr.11. It is an issue. If you've been lied to and tricked into the marriage then you are legally eligible for a divorce maybe even annulment, not too surešŸ¤” My teacher used an example like say you like a guy but they hid a part of their identity like their name then it's kind of like being deceived. Like you know how in Kurban Saif lied to Kareena about being a prof? That counts. I'm probably getting my facts mixed up so don't mind mešŸ˜† And I'm only going by what I learned in Canadian law, maybe it's different in India?

Edit: I googled annulment in Canada. Apparently you can get an annulment if your partner was married before and you didn't know but I dunno if it means hiding the fact you were divorced or in terms of multiple marriagesšŸ¤” Fraud counts too but would you consider this fraud? I know Yash's parents, especially his mom will

Yes, it's very different in india where each community is governed by its own set of "personal laws". So Hindus are governed by the Hindu marriage act, Muslims by the Muslim personal law code, etc.

Under the Hindu marriage act, grounds for divorce are several, including adultery, renouncing the world and not being heard from for 7 years šŸ˜†, leprosy šŸ˜• etc...

But you're right. India is different so I'm not sure how this issue would be dealt with. Here in Canada there's a set of law for everyone. So for this issue, would we have to look into the Hindu law code?
