Vishaka will be back but hopefully the creatives will show a different persona to her character. If the worst case scenario happens and the picture is of no use then can the pandits statment, or Devki or ammas admission of the Wife swap do the job?
As for the 10-30 years punishment..........they might not show that, I mean might reduce and might go for a leap of few years.........Agle Janam might be going for a leap and the zee creatives have a habit of copying tracks from one serial to the other.

Misti you are absolutely right about CVs not being realistic and have been forgetful .... as far as Shantanu is concerned he could be used as a witness to add more lies to Vish's story he can easily say that the wedding picture is Radha's and not Radhika's he can also easily claim Radhika to be Radha and his wife and not Dev's as he seems to have his wedding pictures which can very easily prove that the bride in the pictures is similar to Radhika .... but Dev knows about his story and once he realizes Shantanu turning against RaDev, I don't think Dev will allow Shantanu to win that battle as we know how strong Dev is..... he can use Shastri ji and entire Vrindavan to witness that Radhika was never married to Shantanu so here Shantanu can't claim Rads to be his wife ... but to prove his claim that picture is of Radha and not Radhika the photographer who took the pictures can be easily called as a witness who can identify that Radhika's reflection in water is from the same wedding due to clothes of the bride or some other things which are in water reflection in the picture but we the viewers never paid attention to ... so Shantanu's claims are not going to be enough to prove Rads wrong .... BUT I have a feeling that this negative Shantanu character is actually not negative.... he is creating all these problems for RaDev to help Rads get out of her shell and be a fighter .... since he knows that RaDev love each other like maniacs he is actually trying to bring out each baddie's reality out in the open so Dev can protect Rads in the future ... the first one he started is with Vish now all family members know how low Vish is and obviously she will never regain the respect she lost. His next target will be Mrin and then Chacha and Arjun ... if my observation is correct then I would love to see how he will bring out the reality of the Trio.
Yes Devki, Amma, Purab, Pandit who was going to break the marriage and the Producer with whom Vish was meeting on the day of her wedding can also be called as eye witnesses .... Devki's statement would carry more weight as she was a part of this fraud and she could force Amma, Purab and Pandit to tell the truth and them being under oath may not have a choice but to speak the truth .... II have a strong feeling that this time Devki will fight to protect Rads ... and Shastri ji would not let Devki do any adharam when it comes to Rads ..... I also think Dadi, Vaishali and other Purohit members will be able to put two and two together ... specially when Vaishali and Mrin knows that Amma was actually going to swap the bride at the second marriage so they know that Amma is capable of doing that ... Dev on the other hand is also aware that Amma proposed to let Radhika pose as Vish during the RP pooja and Dev as a Raj Purohit who weighs things socially and religiously can figure things out as to why the pandit said that there is only one marriage in Dev's kundali and nothing can change that, he will sense as to why during first marriage he was feeling that his bride was Radhs when he held her hand and touched her during the ceremony and also why Rads was keeping all those fasts that only married women are supposed to keep there are other things which are enough for Dev to believe Rads being his first wife .... Remember in the promos they both said we will fight this battle together ..... so currently the web of problems is being created for RaDev and once Dev is convinced that Rads is also his first wife then they will both fight tooth and nail together and like you said if the CVs take the logical path the court episodes would be a treat for us to watch lot of secrets of lot of people will unfold during the court battle .... I hope CVs show such tracks.
I also want Amma's truth about burning Rads to come out and want the Raj Purohit to punish her by throwing her out of Vrindavan. As far as Vish is concerned obviously CVs are not going to send her to jail for 30 years I wish they could, but they love her too much, but when I said 30 years I was talking about the reality and of course CB is a fiction so there is hardly any reality. Let's hope the upcoming episodes are less stressful for us.
