hello people
please someone correct me if I am wrong.
Although I don't know what's the matter, but as far as I could understand, someone posted something defamatory against rupali ganguli and she lives in UK, however RG filed a case here in India (criminal case or civil suit Idk)
but
I think she can file the case if the post is accessible in India even if posted from any other country/jurisdiction.
also if her statement Causes harm to the reputation of the Indian person in India in this case rupali ganguli.
but why just restraining order
because I don't know whether the case is that strong, also I don't think that The UK is unlikely to extradite someone for defamation, as it is not considered a serious criminal offense.
also I don't think that the matter must be that big to involve 2 diff jurisdictions all together.
lekin what's the matter.

hey, I could not understand the question I guess, so I will try to tell all the possible situations.
Again I might be wrong, so feel free to correct me.
dekho, as far as I could read they have put restraining orders, matlab I think they have either verified her post or they will verify the post, isiliye bola hoga ki remove karo abhi keliye.
btw defamation kaa punishment is serious, they have toh just asked her to remove the post.
accha vaise
you are talking about the same person or the diff person in diff situation?
see, if the same person does this even after the court orders, toh they might penalize her, also the punishment of defamation goes up to 2 years I guess.
but aaise itni itni baato keliye punish karenge ki nahi I don't know. haan but they can penalize the person.
also Indian citizen keliye bhi there is same punishment, infact there are no constraints here because unlike a foreigner citizen he/she lives in India and 2 jurisdictions are not involved.
in case if someone is a foreigner but lives in India and Since they are physically present in India, Indian courts have territorial jurisdiction to prosecute them because a foreigner does not have special immunity from Indian laws just because of their nationality. If they are residing in India, they are subject to Indian laws just like any Indian citizen.
haan but if a person has any diplomatic immunity like they are diplomatically representing their country, I mean as an ambassador, then it is not easy to prosecute until and unless their immunity is waved which is vvvvvv difficult
but prosecution bohot serious cases mei hota hai, even in this case they have just asked her to remove the post
that's why I am just guessing, mujhe toh ye bhi nahi pata ki post kya kiya hai, I just know that someone posted something defamatory against rupali that's it.
