Yes, kidnapping is more severe offence then abduction. Kidnapping is punished with minimum 7 years but abduction the maximum imprisonment is 7 years and it have to accompany other offence under criminal law . ( so we get the idea how grave this offence is)
Alongwith kidnapping there is cheating, fraud and now if birth documents of the child are also changed then its also forgery for which both Armaan and Rohit will be equally liable.
Stealing is not what happened here, you can commit theft only against a movable property not against a human being.
Regarding liability of both Men.
Armaan and Rohit are absolutely liable in all these charges why let me explain.
1. When Rohit handover/ gave up his child, Armaan knew he didn't have proper authority to give up his baby on his own. [ A father can also be charged for kidnapping his own child if he have exceeded his rights Ober child and took him away from other parent lawful custody, which isnehat exactly Rohit did]
Consent of both parties is essential for legally adopting a child, now saying that Ruhi was in coma so Rohit can give up his child. Again no even if one parent is unable to give their consent then also both parties ( bio parent and adopter family) have to take permission of the court/ magistrate/ board in which court etc will inquire into the reasoning for adoption and see if it's necessary and essential for the benefit of the child.
Did any of men followed this legal process. This is for the adoption which is a legal process, what was shown in the series is not even adoption, it was kidnapping in truest sense.
2. Alongwith kidnapping, doesn't Armman knows that both these men have cheated the mother isn't that's why both are running sometimes behind nurse, sometimes behind doctors so that they don't reveal the truth. Does this not indication of their deceitful intention.
3. Yes if Rohit handover the child but armaan have the knowledge that it's not his place to give up the child so he is also liable.
Unless there was complete lack of knowledge or intention of Armman part about child origin and Armaan legally adopted a child then only he wouldn't have been liable but he is absolutely liable here.
Now would these kidnappers be shown as criminals or whitewashed depends on the itv so called family oriented show because let's face it one of them is the beloved ML so I don't think itv would actually be bold enough to show him and his brother as what they are two Criminal.
