Marital rape is a criminal offense in Pakistan punishable under Section 375 of the Penal Code. It is treated the same as any other rape in Pakistani law punishable with death by hanging or up to 25 years in prison. Marital rape is not an offence under Zina law, which is the Islamic law relating to unlawful sexual offences. The main issue in Pakistan is dearth of reporting and prosecution.
India remains one of the 36 countries in the world that has not criminalized marital rape. When a Bill to criminalize marital rape was introduced, it was rejected by Parliament on the notion that marriage is a sacred institution and touching it will lead to the breakdown of culture and society.
Marital rape is explicitly criminalized in Nepal
In Sri Lanka, as per the current position, marital rape is legally identified as a criminal offence if the spouse is judicially separated or the wife is under 16 years
Marital rape is partially criminalized in Bangladesh and attracts a much lower punishment than non-spousal rape. The colonial Penal Code of 1860 was amended to criminalize marital rape.
Exclusion of marital rape has been a colonial legacy under Article 375 of Indian Penal Code of 1860 which exempted marital rape, as at the time British common law and Victorian mores believed in coverture and implied consent. In Pakistan and Bangladesh, this article in the penal code has been amended. They have been trying to do that in India but the bill has yet to pass.
