Akshara didn't send the legal notice but her solution is the same, she is asking Abhimanyu to visit Abhir once in a month, Abhimanyu wasn't going out of his way to meet Abhir, he wasn't taking any step to deny Akshara and Abhinav's right on Abhir.

Ak stopped trying to contact Abhimanyu only after hearing him yell on phone that he neither cared about Ak nor her baby. So how is this her fault?

That was the misunderstanding right? She assumed Abhinav told him the truth and after knowing about the child, Abhimanyu said he doesn't want anything to do with it but that is not being used in the story anymore
