There are two things.

Dream hua tob aksbu may take some step which will put abhir's health into risk. So birla's will go for custody considering akshu as some one who is very careless about her child health.

But if does not speak up for akshara when his mother is blasting akshara there is no redemption for abhi. He would have put akshara through trauma again, not to mention allowed his evil, begairat, wicked mother to put his sons life at risk
