No you are missing out the detail, that, Seven years clause is not any ground, it's just a remedy given to a spouse whose other half is missing for more than seven years.....

See as per law, Virat cannot marry till seven years of Sai's missing but he did marry Patralekha even before that, so the marriage is automatically null and void....... hypothetically he has to wait for Seven years then has to approach Court for dissolution of his first marriage as his wife didn't return then court will order investigation and after enough proofs they'll declare Sai dead and dissolve his marriage with her and only after that he can marry Patralekha and make it legal.......but idhar to aisa kuch hua hi nhi.....it's clear bigamy case, Sai can easily put him behind the bars, bcoz she was happening and alive, also didn't even hid her identity, so she was very much an alive person in eyes of law yet Virat assumed her dead and marry another without taking divorce from her ....... that's bigamy 😬

I said it, if Sai files for Bigamy she will have to prove that Virat is a criminal and Virat will have to defend himself

See, In such cases wife has to prove that 2nd marriage took place and to gather evidence for that is almost impossible as 2nd marriage doesn't take place in front of family or friends, but Virat and Pakhi got married in the court so their marriage certificate is enough evidence to convict Virat

Virat's case is strong too because Sai was hiding for years and they assumed her dead. For his 2nd marriage, he might have submitted death certificate of his first wife so he can easily prove that he didn't commit bigamy as everyone assumed his wife was dead

What Virat can do if he wants Pakhi?

File for divorce and custody,

What Virat can do if he wants Sai?

He has to bring Sai home and make sure Pakhi doesn't file a cheating case against him

@red, this will happen because Sai will not lie so she will accept to this explanation.

@blue, till now, we know that virat might not want Pakhi as wife, so he will not file for divorce.

@green, so you are saying by default pakhi's marriage is void and hence if she doesnt file complaint, then Virat can be in his first marriage?

What if Red happens, but Sai doesnt want Virat anymore. How can she come out of the marriage? Virat will not file for divorce lets assume. May be this is what he means "making her life miserable". Divorce nahin dega, pakhi ko bhi nahin chodega. 🤢

Nora, shree just going by what you said, this plot is going to be SO tight.

Why cant vankar show court drama. BK and her reputation will be collateral damage. I would love to see it.

He'll make Sai's life miserable something that Sai would hate & won't want. Anything related to Virat Pakhi will not make anything as such revenge to her. It'd be something else personal.

But Sai was very much alive legally, she was running a home school, was about to build hospital, gave birth to a child with her own identity so she didn't hid from administration, she left only Virat.....So for administration she was alive, so if anybody has issued Sai's death certificate then it's negligence of the said authority, court can take them in hand........

But this cannot let Virat get away, it can only lessen his punishment......and his marriage with Patralekha will become immediately null and void......

So if he wants Pakhi.....then he has to divorce Sai and later remarry her...

And wants Sai ......then she is already his wife, he has to convince Pakhi that she doesn't file a case against him for bigamy....

So in all probability Sai is still Virat's wife legally and Patralekha stands no where in Virat's life in the eyes of law, till the time he actually divorce Sai.....

Ps: But this is talking about Laws of our land whereas we know Ghumverse has all the different laws, so anything can happen 😲

Exactly that's why Sai won't file a complaint against him. Bigamy is a non cognizable offence, Sai has to file a complaint for it and if she believes that he assumed her dead then she won't do it

Yup, Pakhi and Virat's marriage is void by default if Virat acknowledges his first marriage, the issue will be cheating case on him by Pakhi

Sai can file for divorce and they have been living separately for years so no judge will deny it, Virat can say he doesn't want divorce and if he refuses to attend 3 consecutive hearings (I think) then Sai will win

Its a legal mess and only fake marriage can make them come out of this without any legal issues but even that's not a possibility now because makers took it too far with VP. He has publicly announced her as his wife time and again. Death of Pakhi can make it simple but that won't happen so out of court settlement is the only way .

Because bigamy is a criminal offence 😆 If I am filing a case against someone to send him to jail for 7 years, I hate him enough and don't want to be with him. It was like Sai filing case against Pakhi, she wanted punishment for Pakhi but spared Virat and Kaku
