It becomes criminal offence if he marries without first wife's consent. Sai will not lie and will say that he married assuming she is dead. So yeah the second one gets nullfied by default and then she divorces.
If Sai files a bigamy complaint, it will be tried by a criminal court under section 494 of IPC, The case is filed to send the accused to jail, it's not to get rights for first wife, when Sai files it she wants to see Virat in jail for his crimes
Here Virat has to prove that his marriage to Pakhi wasn't bigamy because when he married her, they assumed Sai was dead and because they married in court, he can't deny the existence of this marriage as it's in public records. He did it for whatever reasons, doesn't matter
If he proves that his marriage to Pakhi doesn't amount to bigamy, it means the marriage is legal. If Sai proves that she was victim of bigamy then Virat will be in jail for 7 years + fine
Even Pakhi can file a cheating case on Virat because like Sai, she too is victim of bigamy
After this, Virat or Pakhi will have to file for an annulment or divorce on grounds of no consummation. Criminal court can't declare their marriage as void because they didn't consummate it, it doesn't matter in this case
They have been living separately for last 7 years so 6 months thing won't play out
