The answer is that there's no legal recourse for him because it isn't considered rape at all. On the other hand, even American style- debates on abortion do not take place in India. Theoretically everyone can get abortion unless it is a sex-determined one. Courts can't give an order regarding these matters without reinterpretating both the laws. Which has other implications. If court 'ordered' a woman to get an abortion on the pretext of rape of the father, that murkies the waters when it comes to girl foeticide.

But let's not talk about these issues anymore, I agree.
