so lemme ask...
It's socially acceptable that a rape victim (female) can chose to abort the child resulted from molestation; so can a rape victim (male) also ask the perpetrator to abort the child w/o backlash?
And if he does ask and she refuses then does he have a recourse social or legal?
I've been a silent reader and I don't think I can hold my silence anymore, given my heart just keeps growing for these Imlie and Aryan. So, might as well start here..
To answer your question, since our law doesn't actually acknowledge that men can be victims too, with Section 375, being gendered, in the first place.
Medical Termination of Pregnancy Act, again, is gendered. In its current form, women alone have a right to decide whether they want to continue their pregnancy or no. Men have no say in it. So, again, he can say no to pregnancy and it wouldn't matter.
The most he could probably get is refuse to take responsibility of the child and cite the circumstances behind the pregnancy if the mother asks for maintenance for the child. But how far Indian courts would actually consider it, is a point for debate.
