It’s not a criminal but a civil case.
It is not the same thing because these were employees discriminating against other possible employees. It would go against the company hiring policy itself.
The US has laws regarding equal opportunity hiring but these things have a lot of technicalities. An owner of a company can definitely hire his daughter if he wants to. But if he puts out a hiring notice and then discriminates based on skin tone or cultural background or age, etc, that would be against the law. You basically cannot say there are positions open and then discriminate in how you hire for them. If a public job opening notice is never put out at all, that does not apply.
Hell, it's very common policy even in big companies to just ask your coworkers if they know someone who wants a job. They will recommend a friend or someone they like and they are usually hired. Only if nobody is available, then a formal 'hiring' notice is put out.
